You are welcome (hereinafter referred to as "user" or "you") to sign this "User Agreement" (hereinafter referred to as "the Agreement") with Oumi operator and use Oumi services! The title of each clause is only to help you understand the purpose of the clause, and does not affect or limit the meaning or interpretation of the terms of the Agreement. In order to protect your own rights and interests, it is recommended that you carefully read the specific expressions of each clause.

[Please Read Prudently] Before you click to agree to the Agreement in the application registration, you should read it carefully (if you are a minor, you should read it with a legal guardian) and fully understand the contents of the terms of the Agreement, especially the exemption or restriction of Oumi’s responsibility, the terms restricting the rights of users, the terms of application laws and the terms of dispute resolution. The clauses exempting or restricting liability will be marked in bold black, and you should read them carefully. If you have any questions about the agreement, please do not proceed to the next step, and you may consult the customer service personnel of Oumi. Oumi operator has fulfilled its legal obligation to take reasonable measures to draw users' attention to and explain the relevant provisions, and has given users sufficient time and sufficient options to decide whether to conclude the Agreement.

[Contract Signing] When you fill in the information, read and agree to the Agreement and complete all the registration procedures according to the prompts on the registration page, it means that you have fully read, understood and accepted all the contents of the Agreement, and reached agreement with Oumi operator to become a "user" of Oumi. In the process of reading the Agreement, if you do not agree with the Agreement or any of its provisions, you should immediately stop any further process and stop using Oumi services. If you click on the buttons of "Agree", "Accept", "Register Account" etc., or actually use Oumi services, it is deemed that you have fully accepted and signed the Agreement. If you have not applied for the registration process, or have become a registered user of Oumi before the Agreement comes into effect, then by accessing and / or using Oumi, you are deemed to have agreed to accept the entire contents of the Agreement, otherwise you have no right to access or use Oumi.

[Agreement Modification] After you sign the Agreement, the content of the Agreement may be modified due to changes in national policies, product functions and forms, operating plans, and the environment in which the Agreement is performed. The revised agreement is posted on Oumi and you may view it at any time. If you have a protest against the revised agreement, please immediately stop logging in and stop using Oumi service. If you log in or continue to use Oumi, it is deemed that you have recognized the revised agreement and agreed to be bound by it.

[Overseas Users] If you are not a user in Hongkong, China, you must also abide by the laws of your country or region, and you confirm that the conclusion and performance of the Agreement does not violate the laws and regulations’ of the country or regional area where you belong, live or carry out business activities or other business.

Oumi: refers to Oumi website and app.

Oumi services: various services provided by Oumi operators to you based on the Internet in various forms including Oumi website, users, etc. (including new service forms that will emerge in future technological development). If the user logs in or uses the products or services of the affiliated company of Oumi operator, and the associated products or services do not have an independent user agreement and private policy, the Agreement also applies to those products or services.

Oumi operator: Onlyou Co., Limited and its related parties.

Oumi rules: including all rules, interpretations, announcements and other content that have been published and subsequently published on all Oumi websites, as well as various rules, implementation rules, product descriptions, announcements, etc. published on Oumi channels and event pages, such as “Oumi Agency Violation Management Measures”, "Chat Room Management Standards", "Master Management Rules", "User Behavior Rules", "Information Release Standards", etc. You know and agree that the subsequently updated and adjusted Oumi rules are an integral part of Oumi rules. Oumi rules have been fully publicized and are effective and binding on all users of the platform. User: hereinafter referred to as “you” or “user”, refers to the individual or organization that registers, logs in, uses, browses, and obtains services under the Agreement.

3.1 Signing subject

The Agreement is an agreement between you and Oumi regarding registration, login to Oumi and use of Oumi services. The Agreement has a contractual effect on you and Oumi operator. Oumi operators refer to the legal entities that operate Oumi. Under the Agreement, Oumi operator may change according to Oumi's business adjustments. The changed Oumi operator will perform the Agreement jointly with you and provide services to you. Oumi operators may also be added because of new Oumi services. If you use the newly added Oumi services, you are deemed to agree that the newly added Oumi operators will perform the Agreement with you. In the event of a dispute, you can determine the entity and the counterparty to the dispute based on the services you specifically use and the specific behavior objects that affect your rights.

4.1 User qualification

You confirm that before you start to use/register the program to use Oumi services, you should have the capacity for civil conduct that suits your conduct as required by the laws of your area. If you do not have the aforementioned capacity for civil conduct appropriate to your behavior, you and your legal guardian shall bear all consequences arising therefrom in accordance with the law. Minors under 12 years of age are not allowed to register as Oumi users or use Oumi services. If the user is a minor over 12 years old, his legal guardian should read, understand and agree to all the contents of the Agreement and its revised contents before they can start to use or continue to use the service; if the user starts to use or continue to use the service, it is deemed that his legal guardian has read, understood, and agreed to all the contents of the Agreement and its revised contents.

In addition, you also need to ensure that you are not the object of trade restrictions, sanctions or laws and regulations imposed by any country, international organization or region, otherwise you may not be able to register and use the service normally.

4.2 Account description

When you fill in the information, read and agree to the Agreement and complete all registration procedures according to the prompts on the registration page, you can get a Oumi account and become a Oumi user. You have the right to log in to Oumi using Oumi user name (hereinafter referred to as "account name") and the password (account name and password collectively referred to as "account") that you have set or confirmed. Because your Oumi account is linked to your personal information and Oumi business information, your Oumi account is limited to your own use. Without the consent of Oumi operator, you are not allowed to directly or indirectly authorize a third party to use your Oumi account or obtain information under your account. All responsibility and consequences arising from your account shall be borne by you, and Oumi operator shall not bear any responsibility for this. However, if Oumi operator determines that the use of your Oumi account may endanger your account security and/or Oumi information security, Oumi operator may refuse to provide corresponding services or terminate the Agreement. Since user account is associated with user credit information, you can only transfer the account if there is a legal requirement, a judicial ruling, or with the consent of Oumi operator and in compliance with the user account transfer process stipulated in Oumi rules. Once your account is transferred, the rights and obligations under the account are transferred together. Except for this, your account must not be transferred in any way, otherwise you will bear all the responsibilities arising therefrom. In order to enable you to better use the services of Oumi and protect your account security, Oumi operator may require you to complete the real-name authentication according to the requirements of Oumi and legal regulations. If your account has not been logged in for a long time, Oumi operator has the right to cancel, recover, replace or delete any records of your account in Oumi database (including but not limited to registration information, virtual gift information, etc.), and your account will no longer be able to be logged in to any Oumi platform, and the corresponding service will be terminated at the same time. Oumi will notify you by including but not limited to pop-ups, website announcements, site messages, and user-side push information before cleaning up such accounts.

4.3 Registration Information Management

4.3.1 Authenticity and Legitimacy

When using Oumi service, you should provide your information accurately (including but not limited to your identification, contact number, etc.) as prompted by Oumi page, so that Oumi can contact you when necessary. You understand and agree that you have an obligation to maintain the authenticity and validity of the information you provide. The account name you set must not violate the laws and regulations and Oumi rules regarding account name management, otherwise Oumi operator can suspend or cancel your account name and report it to the competent authority.

You understand and promise that there will be no illegal or undesirable information, no use of affiliated institutions or celebrities in your account name, avatar, profile and other registered information. You must abide by the bottom line of laws and regulations, citizens’ legal rights and interests, public order, social morality and the authenticity of information during the account registration process.

If Oumi operator finds that any of your custom name such as your account registered or used in Oumi is the same as other users, making the name unrecognizable, Oumi operator has the right to ask you to modify the above name. If you fail to modify the name within the time limit requested by Oumi operator, Oumi operator has the right to distinguish it by adding an identification symbol, and you promise to unconditionally agree to the above modification.

You understand and recognize that Oumi implements some product technical functions (such as embedded code, plug-ins, etc.) by accessing third-party services. The above-mentioned third-party services can only access the personal information of users required to perform their duties and ensure that they will use industry-leading technology to protect the security of your personal information. You agree and authorize that, in order to better provide services for you and ensure the security of your account, the operator of Oumi platform can initiate an inquiry of user's identity authenticity, credit record, and mobile phone number validity status from telecommunications operators, financial service institutions and other reliable organizations according to the mobile phone number, ID card number and other information you provide.

4.3.2 Update and Maintenance

You should update the information you provide (including but not limited to registration information, etc.) in a timely manner to ensure that it is timely, detailed, true, and accurate. In cases where the law clearly requires Oumi operator to verify the information of users, Oumi operator will check and verify your information from time to time according to law, and you should cooperate to provide the latest, true and complete information . When you change or delete relevant information, you may also cause the loss of content, pictures, videos, etc. stored in the system. Oumi operator is not responsible for the loss of content caused by your independent operation. If Oumi operator fails to contact you according to the information you provided last time, because you did not provide the information in time according to the requirements of Oumi operator, or the information you provide is obviously untrue or the administrative and judicial authorities verify that the information you provide is invalid, you will bear all losses and adverse consequences caused to you, others and Oumi operators. Oumi operator may send you an inquiry or request for rectification notice, and require you to re-authenticate, or suspend, or terminate to provide part or all of Oumi services. Oumi operator is not responsible for this.

4.3.3 Account Security Specification

Your account is set up for you and kept by you. Oumi will not ask you to provide your account password at any time. Therefore, it is recommended that you keep your account safe and ensure that you log out and leave Oumi with the correct steps at the end of each online session. If you take the initiative to notify Oumi operator and require Oumi operator to take measures to suspend the login and use of your account, Oumi operator should require you to provide and verify personal valid identity information consistent with your registered identity information, otherwise Oumi operator has the right to refuse your above requests. If Oumi operator verifies that the personal identity information you provided is consistent with the registered identity information, the operator shall take timely measures to suspend the login and use of the user account. If the user does not provide his personal valid ID or the personal valid ID provided by the user is inconsistent with the registered identity information, Oumi operator has the right to refuse the user's above request. The loss and consequences of the account due to your active disclosure or because you have been attacked or defrauded by others will be borne by you. Oumi operator is not responsible, and you may recover from the infringer through judicial, administrative and other relief channels. Your account is accessible to you only and cannot be borrowed, donated, rented, transferred, sold or shared by others without the prescribed procedures. When your account is used without authorization, you should immediately notify Oumi operator, otherwise the unauthorized use will be regarded as your own behavior, and you will bear all the losses and consequences arising therefrom. Except for the fault of Oumi operator, you are responsible for all the behavior results under your account (including but not limited to signing agreements online, publishing information, purchasing goods and services, and disclosing information, etc.). If you find any unauthorized use of your account to log in to Oumi or other situations that may cause your account to be stolen or lost, we recommend that you immediately notify Oumi operator. You understand that it takes reasonable time for Oumi operator to take action on any of your requests, and the actions taken by Oumi operator at your request may not avoid or prevent the formation or expansion of the consequences of the violation. Except that it is Oumi operator's legal fault, Oumi operator does not assume any responsibility.

4.4 Personal Data Protection

Please refer to the “Privacy Policy” and “Children's Privacy Protection Statement” on Oumi. Once you start using the products or services provided by us, it is deemed that you have fully understood and agreed to the “Privacy Policy” and “Children's Privacy Protection Statement” of Oumi.

5.1 Oumi service

5.1.1 Any website directly owned or operated by Oumi operator;

5.1.2 The user terminals directly owned or operated by Oumi operator, including but not limited to the user terminals of PC, tablet computer, mobile phone, etc.;

5.1.3 Personal center service for Oumi user;

5.1.4 Oumi chat room service: creating and entering chat rooms to participate in voice and text chats;

5.1.5 Oumi message service: private chat, group, friend relationship, etc.;

5.1.6 Oumi invitation, rewards, and red envelope services: initiating invitations, rewards, and sending red envelopes to users;

5.1.7 Other technologies and/or services , such as mini games and the creation, joining, and management of agencies,provided by Oumi (hereinafter referred to as "other technologies and services").

(The above services are collectively referred to as "Oumi services"). Oumi service can only used by yourself on Oumi. Any illegal separation of Oumi service from Oumi by malicious cracking, etc., does not belong to Oumi service agreed in this agreement. The actor is responsible for all legal consequences arising therefrom, and Oumi operator will pursue the legal responsibility of the actor according to law.

The official method announced by Oumi website is the only legal way to register, log in, download, and use Oumi service. Oumi services (including but not limited to accounts, props, downloads, etc.) that you obtain through any other channels or in any way are all for illegal acquisition, Oumi operator does not recognize its effectiveness, and once found out, Oumi operator has the right to delete, freeze, clear, seal, etc. immediately. Any adverse consequences caused by you shall be borne by you, and Oumi operator has the right to pursue the legal responsibility of the corresponding person or organization according to law. Oumi operator has the right to announce to you (including but not limited to pop-up pages, website announcements, site messages, etc.) to modify, replace, and upgrade any software related to Oumi service. If you do not agree or do not accept the modification, replacement, and upgrade of Oumi service-related software, please directly refuse, stop, or cancel all actions of using Oumi; otherwise you are deemed to agree and accept the modification, replacement, and upgrade of Oumi-related software. At the same time, the agreed and accepted actions are still bound by this agreement. You understand and recognize that Oumi virtual items include, but are not limited to, virtual gifts, props, titles, etc. The ownership belongs to Oumi operator, and users can only use and consume in accordance with the rules of the platform in accordance with the law, and the sale or cash out of virtual items is prohibited. You understand and recognize that Oumi operator has the right to establish, add, and modify value-added services and issue value-added service tokens in the platform services as needed. The value-added service token is obtained by using the actual currency. Once the actual currency is converted into the value-added service token, it cannot be returned. The value-added service token is used to purchase the use right of relevant virtual props or accept relevant value-added services, and cannot be converted into actual currency. The platform has the right to award corresponding charm value according to the actual situation of users using value-added service tokens, rewards or giving virtual gifts. The charm value can only be consumed on the platform and cannot be converted into real currency. If there is no special requirement for the using period, it is preset that the user can continue to use all kinds of virtual items in Oumi after obtaining the right to use until the corresponding Oumi service is terminated; if there is a special requirement for the using period, you may use the product till the expire date. If the period of use is exceeded, Oumi operator has the right to withdraw its right to use at any time without further notice to the user (the period of use is not interrupted or suspended for any reason). In the case where users purchase the right of using virtual items or accept other value-added services, if the effective period of the virtual item or the effective service period of the value-added service (regardless of whether the user has actually used or enjoyed the service) is expired, or the number of valid uses or services is exhausted, Oumi operator has the right to take measures to cancel the user's right to use the above virtual items or stop providing value-added services. Special Notices: Oumi operators attach great importance to anti-fraud and anti-money laundering. In addition to taking applicable and necessary legal actions, Oumi operator has the right to permanently confiscate, freeze or return to the original recharge account every virtual item and value-added service token in the user's account that we have determined to be obtained by fraud or to be related to money laundering; This includes the virtual items and value-added service tokens obtained by fraud, the virtual items and value-added service tokens presented or traded by other users after obtaining by fraud, and the virtual items and value-added service tokens involved in abnormal transaction or money laundering. If Oumi operator suspects that the virtual items or value-added service tokens you hold are purchased or obtained through fraud channels (whether or not fraudulent means are taken by you), or if the accounts, virtual items, and value-added service tokens are found to be inconsistent with regular transactions, Oumi operator has the right to freeze your account or the corresponding amount of virtual items and value-added service tokens in the account, and will provide you with an opportunity to complain. The judgment and final interpretation right of fraud and money laundering belongs to Oumi operator. You understand and acknowledge that, in view of the special nature of network services, Oumi operator has the right to change, interrupt or terminate some or all of the services (including paid services) at any time. If Oumi operator changes, interrupts or terminates the service, it shall notify the user in time, and shall provide the affected user with an equivalent alternative service. You understand and recognize that Oumi operator enjoys the following rights. Oumi operator ’s exercise of the following rights is not considered a breach of contract, and you do not pursue and exempt Oumi operator ’s related legal responsibilities: for your Experience value, level, following, subscription, title, electronic ticketing, virtual live performance room, virtual items, virtual gifts and rewards, downloads, and any data information generated during the operation of Oumi and stored in Oumi network database (including but not limited to derivatives such as account data information, live broadcast period information, virtual gift information, consumption information, etc.) (hereinafter referred to as "derivatives"), you confirm that you do not have ownership (unless Oumi announces otherwise) , and Oumi operator permits you to use it in accordance with the rules of Oumi, and Oumi operator shall not be liable for any compensation for the above derivatives. Oumi operator has the right to decide the date of recovery according to the actual situation, without further notice to you or your consent.

You agree and guarantee that Oumi service or its derivatives shall not be used for illegal profit-making by reselling, exchanging, mortgage or other valuable transactions; you will not use Oumi service or its derivatives to infringe on the legal rights and interests of others. It is forbidden to steal or embezzle other people's accounts, virtual gifts, etc. by network vulnerabilities, malicious software or other illegal means.

You understand and agree that the value-added service tokens and charm value are prohibited from withdrawing, and any recharge and trading of virtual items performed not on official channel of Oumi are prohibited behaviors. Once discovered, your account will be banned and the account balance, virtual gifts and other value-added services are not refundable. If you recharge your Oumi account or purchase paid services of Oumi (including but not limited to the purchase of the right to use the virtual gifts in Oumi and the acceptance of other value-added services and other types of charging projects) on non-official channel of Oumi, it may result in risks (including but not limited to criminals using your account or bank card and other valuable cards to carry out illegal activities) and your economic losses. Oumi will not be responsible for the aforementioned risks and losses.

The relationship labels and related services provided by the platform for users are only for the purpose of entertainment and interaction, and are not the authentication of the true relationship between users, nor do they encourage, promote or guarantee the establishment of any true relationship between users. The relationships, connections and disputes between you and other users are not related to the platform. The illegal agreement between you and other users and the agreement that is contrary to the terms of this agreement will not be recognized by this platform. The platform will not bear any responsibility for handling the disputes arising from it. For the relevant behaviors that violate the provisions of this agreement and the rules of the platform, Oumi operators have the right to take punishment measures.

5.2 Automatic Subscription Service

5.2.1 Service description: Oumi operator provides users with automatic subscription services according to product needs. The automatic subscription services will be strictly implemented in accordance with the terms of service and operating instructions, and are a part of the platform services. The platform has the right to unilaterally decide and adjust the content and method of the automatic subscription service based on its own operating strategy.

5.2.2 Automatic subscription procedure

1. Before enabling the automatic subscription service, you must register as a platform user based on true, accurate, legal and valid personal information and successfully log in to the platform account, otherwise the platform has the right to refuse or cancel your automatic subscription. If you log in with a third-party account, you should ensure that the third-party account and the information contained in it are true, accurate, legal and valid. If you are unable to log in due to a third-party account issue, you may contact the third party for resolution, for which Oumi platform operator is not responsible. Oumi operator will not refund you the automatic subscription fee you have consumed and will not make any form of compensation/compensation.

2. When you choose the automatic subscription service, it means that you accept Oumi platform automatic subscription service and related service regulations. If you do not agree to any of the foregoing procedures, rules or contents, you are not able to perform automatic subscription operations. Once you have completed the automatic subscription operation, it means that you have no objection to all the procedures, rules and content.

3. You understand and agree that the automatic subscription service is limited to be used in the applied account; that the automatic subscription service belongs to network goods and virtual goods, and the service is provided only after payment; that the cost is for the price of the virtual goods/services you purchased, not for prepayments or savings, deposits, debit card or other uses; and that the automatic subscription service is non-refundable and non-transferable once it is enabled. You can check for free the virtual products/services, and consumption records, etc. that you have automatically subscribed in the platform, and you can also cancel the automatic subscription of the the corresponding virtual products/services.

5.2.3 Service content and service fee of automatic subscription

1. You understand and agree that in view of the diversity of virtual products/services in the platform, the automatic subscription of different virtual products/services has different prices, and the prices will be shown in the page description of the platform and may be adjusted. Oumi operator has the right to adjust the automatic subscription fees and applicable user equipment terminals of all or part of virtual products/services based on its own operating strategies. Such adjustments will be notified by the platform on the corresponding service page or in other reasonable ways.

2. The service period of the automatic subscription service starts from the time you choose to activate the automatic subscription service and ends when you cancel the service or the balance in your account is insufficient. If you need to cancel the subscription, please turn off the automatic subscription function in the app store 24 hours before the current subscription expires.

3. The automatic subscription service is a fee-based service, and the corresponding service fee need to be paid in order to use the service. The platform operator did not provide other ways to obtain the service.

4. Before enabling the automatic subscription service, you should carefully check the account name, and the content, price, service period and other information of the virtual goods/service to be automatically renewed. The automatic subscription service fee is non-transferable and non-refundable when your payment is completed.

5. The charging standard of the automatic subscription service is independently determined by the platform according to its operating strategy, and will be shown to you on the relevant virtual product/service page. If the price of the automatic subscription service is adjusted, the current effective price published on the platform should prevail. You understand and agree that your continued operations (including but not limited to checking automatic subscription, continuing to pay or enjoying automatic subscription services, etc.) mean that you are aware of and agree to the adjusted charging standard.

5.3 Service Specification

The ownership of Oumi account belongs to Oumi operator. Upon the completion of registration, you will get the right to use Oumi account, which right belongs to the initial registrant. You are obliged to properly keep the account and password obtained when registering and using Oumi, and be responsible for the series of activities or activities started after logging in to the system for this group of accounts and passwords. In view of the particularity of the network service, Oumi does not check whether the group account and password are used for you, but only checks whether the account and password are consistent with those stored in the database, as long as the account and password entered by anyone is saved in the database. If you are consistent, you can log in to Oumi with this group of accounts and passwords. If the user is not the initial registrant of the account, Oumi operator has the right to freeze and withdraw the account without notice to the user and without any legal liability. The caused losses, including but not limited to your communication interruptions, and reset of user data and virtual items are borne by you. All activities under the user account are regarded as your own actions, and you are fully responsible for such activities. If the ownership of the user account or user account balance is in dispute, Oumi operator has the right to temporarily freeze the suspicious or disputed account and account balance when discovering suspicious accounts, suspicious funds, abnormal recharges, abnormal transactions, or receiving complaints from related parties. The parties to the dispute shall provide evidence to prove the attribution of the account or account balance within a reasonable period of time. Oumi operator will make a decision on the attribution according to the evidence provided by the parties, and reasonably handle the suspicious or disputed account and account funds.

Unless proven to the contrary, Oumi operator treats you as the copyright owner of the content you upload, publish or transmit on Oumi. Your use of Oumi service to upload, publish or transmit content means that you have the right and have consented to authorize all the intellectual property rights (including but not limited to copyrights, trademark rights, and all related derivative rights) to Oumi operators with a global, irrevocable and permanent free use of all the uploaded content (including but not limited to video, audio, hereinafter referred to as “Performance”) you publish or transmit on Oumi. During the agreement period and after the agreement expires, Oumi operator can use the above performances in any way and enjoy the corresponding benefits. Without the prior written consent of Oumi operator, you are not allowed to provide or authorize any third party to use in any way and get any income.

In order to facilitate your use of Oumi and other related services of affiliated companies, you authorize Oumi operators to pass the information you provided and formed during the account registration and use of Oumi services to other related companies service providers such as affiliated companies of Oumi operators.

You can purchase value-added services for virtual products while using Oumi services. If there is no special instructions, you can obtain virtual products through Oumi or the legal channels authorized by Oumi. The specific usage methods and duration are subject to the instructions attached to Oumi page or similar official documents with the above explanatory nature. The virtual product will be adjusted at any time due to factors such as user needs, website strategy adjustment, user acceptance, etc. For specific information, please refer to the page description at the time. Based on the nature and characteristics of virtual products, Oumi operators do not provide refund or exchange services for virtual products. If you consume all the obtained virtual products and will not continue to use the virtual product service, the service will be terminated.

You should abide by the terms of this agreement, use this service correctly and appropriately, and must not disrupt the order of Oumi, including but not limited to disrupting the financial order of Oumi (such as selling virtual property, virtual gifts, etc.). Unless you are authorized in writing by Oumi operator, you may not use virtual products in the commercial field, including but not limited to trading, exchanging, mortgage, or using virtual product services in a specific way to obtain improper profits. It is important to note that if you are suspected of using unreasonable means to recharge your account (including but not limited to illegal use of credit card cash), Oumi operators have the right to temporarily or permanently close your account based on reasonable judgment. At the same time, Oumi operator reserves the right to withdraw the account, user name, account funds, and virtual products at any time.

Any user should obtain Oumi virtual product services through legal channels. All virtual products and their derivative services obtained through unofficially announced channels shall not have legal effect on Oumi. Oumi operators have the right to unilaterally withdraw related virtual products and terminate corresponding services. The legal disputes caused by your civil actions with others on Oumi shall be handled or resolved by the parties on their own, and Oumi operators do not assume any responsibility. Oumi operators will actively cooperate with police investigations to help users maintain their legitimate rights and interests.

You understand that when using Oumi services, you are exposed to a wide range of content and information sources. Oumi operators cannot be responsible for the accuracy, authenticity, availability, security, integrity, and legitimacy of the content and information. You understand and acknowledge that you may be exposed to incorrect and unpleasant, inappropriate or offensive content and information, or anonymous or infamous information that infringes on the rights (including intellectual property rights) of others. These risks are not as a result of Oumi operator, you can not held Oumi operator accountable for the related responsibilities. You can inform Oumi by promptly complaining to the official customer service of Oumi. Oumi operator has the right to stop transmitting any of the foregoing content according to law and take corresponding treatment, including but not limited to suspending your continued use of part or all of the services of Oumi and keeping relevant records and report to the relevant authorities.

Oumi platform will not endorse, recommend or express opinions on any content and information uploaded, published or transmitted on Oumi platform, nor shall it be liable for any error, defect, loss or damage of any content and information. Any use of content and information is at your own risk.

You agree that Oumi operator will place commercial advertisements or any other type of commercial information in various ways during the process of providing services (including but not limited to placing advertisements on any location of Oumi, and placing it in the content you upload and disseminate Advertising), you agree to accept Oumi operators to send you promotions or other relevant business information via email, in-site messages, SMS, telephone, instant messaging tool, website announcements or other means.At the same time, Oumi operator has the right to add watermark of website logo (or name) and time in the live broadcast room. Oumi operator will do its best but does not guarantee that it will not affect your platform experience.

You should restrict your user behavior on Oumi by yourself, and ensure your personal safety and property safety during online live broadcast, accompanying play and performance. Oumi operator shall not be liable for damages for personal and property losses caused by your own reasons, force majeure, unexpected events or third-parties.

During the use of Oumi service, you must abide by the laws and regulations of Hongkong, China and your region regarding computer and Internet regulations. In any case, once Oumi operator reasonably believes that your actions may violate the above laws and regulations, it may terminate the provision of services to you at any time without prior notice.

You agree and acknowledge that once you choose to download Oumi, purchase the right to use related virtual items, or accept related services, it indicates that the user has fully understood and accepted the corresponding charging methods and price. User agrees that Oumi operator has the right to determine the charging method and price of Oumi service. Oumi operator has the right to determine different charging methods and price for the various services of Oumi at different stages, and Oumi operator has the right to adjust the price policy as needed. You agree not to bypass Oumi's charging methods and price in any form for online or offline transactions, and you may not evade Oumi's charging methods and price through private transaction channels.

5.4 Prohibited Content

You understand and guarantee that the content you create, upload, publish or transmit on Oumi (including your account name, comments, barrage and other information) does not contain the following content:

(1) Leaking state secrets, endangering national security, endangering national defense, or harming national honor and interests;

(2) Hateful speech or conduct, including any content that promote racism, terrorism, ageism or sexism;

(3) Arouse people's hatred and contempt for the government and arouse dissatisfaction with the government;

(4) Pornographic, obscene or indecent, or any adult content, including any form of child exploitation;

(5) Excessively violent, including any content that is related to death or serious injury;

(6) Disturbing social order, destroying social stability, and suspected of shaking the public's confidence in law enforcement;

(7) Depicting, encouraging or assisting suicide or self-harm;

(8) Rumor, false or misleading information;

(9) Profane, blasphemous or any content that may offend people of certain faith, or otherwise related to religion;

(10) Related to gambling, abortion, weapon, or other highly explosive subject matter;

(11) Abusive, libelous, or otherwise harassing other people or group;

(12) Infringe on the legal rights and interests of others;

(13) Spam, junk mail or other unsolicited advertisement;

(14) Other contents prohibited by relevant laws, administrative regulations and state regulations;

(15) Oumi determines that it is negative content or other content that is not suitable for publishing or transmission.

If the content you upload, post or transmit contains information or content that violates the above laws and regulations, or violates the legal rights of any third party, you will directly bear all the adverse consequences caused by the above. If this causes adverse consequences to Oumi, you shall be responsible for eliminating the impact and compensating all losses caused by this to Oumi operator, including but not limited to property damage compensation, reputation damage compensation, attorney fees, transportation fees, and any other reasonable expenses arising from the protection of rights.

5.5 Prohibition

You understand and guarantee that you will not perform the following prohibited actions on Oumi, nor allow anyone to use your account to perform the following actions:

1) Impersonate another person or organization, or misrepresent that you are in contact with any person or entity (including setting a false account name or access another user's account), or use maliciously your registered account, leading to misidentification of other users when registering an account, or using Oumi services (including but not limited to uploading, publishing, disseminating information, etc.);

2) Forge the title or manipulate the content in other ways to make others mistake the content as being transmitted by Oumi;

3) Upload, post, email or otherwise transmit content that is not authorized to be transmitted (such as internal information, confidential information, content that infringes anyone ’s patents, trademarks, copyrights, trade secrets or other exclusive rights, etc.);

4) Upload, post, send e-mail or transmit in any other way any unsolicited or unauthorized "spam", advertising or promotional materials, promotional materials, or any other commercial communications;

5) Without the explicit permission of Oumi operator, use Oumi services for any commercial purpose or for the benefit of any third party;

6) Track or harass others in any other way;

14) Without the explicit consent of others, share or publish personally identifiable information of such persons;

16) Decompile, reverse compile or reverse engineer the software used by Oumi service, or try to make the above matters;

17) Open multiple accounts for the purpose of destruction or abuse, or maliciously upload duplicate and invalid bulk data and information;18) Perform any behavior that undermines the fairness of Oumi services or other activities that affect the normal order of the application, such as active or passive scoring, partnership cheating, use of plug-in or other cheating software, and use of BUG (also called "vulnerability" or "defect") to obtain unlawful and illegal benefits, or use the Internet or other methods to make the plug-in, cheating software, and BUG public;

20) Maliciously discredit and defame Oumi or its operator, spread relevant comments or reports that damage Oumi or its operator, instigate fans, netizens or other online groups to maliciously attack Oumi or its operator, regardless of whether your Oumi account has been banned or cancelled;

21) Without the written consent of Oumi operator, publish comments on Oumi or its operators on any news media, self-media and other platforms, and accept interviews about Oumi or its operators, regardless of whether your Oumi account has been banned or cancelled;

22) Intentional or unintentional violation of any relevant laws, regulations, rules and other legally valid regulations in Hongkong and the region you are in.

5.6 Consequences of violation

If you violate the provisions of this agreement, in addition to being penalized according to other provisions, you also agree to bear one or more of the following penalties decided by Oumi operator:

1) Warning: Warning is merely an educational guide for users who violate the rules of the platform. It is a way to manage the normal operation of the platform.

2) Banned to make a speech: Close some or all chat channels of violating users, force the suspension of the online dialogue function of the user account, and prevent the user account from talking with other users until the penalty expires or is cancelled.

3) Temporarily freezing the gameplay: limit the service permissions of the violating users and restrict some of their platform service operations until the penalty expires or is cancelled.

4) Permanently freezing the gameplay: limit the service permissions of the violating users, restrict some of their platform service operations, and never release or release them forever.

5) Temporarily prohibiting login: The user account of the violating user will be temporarily unable to log in using one or several platforms provided by Oumi for a certain period of time, until the penalty expires or is cancelled.

9) Taking legal responsibility: If the user's improper behavior causes damage to others or Oumi or violates the current legal provisions, the user who violates the rules shall bear the corresponding civil, administrative or criminal responsibility according to law.

10) Dissolving organization: Dissolving organizations established by users including but not limited to agencies and other organizations.

11) Modify nickname: Users’ character nicknames, gang names, chat room names, group names, etc. that can be independently named by the user are forcibly modified.

12) Temporarily restrict service from platform: The user account of the violating user will be restricted from some services within a certain period of time.

13) Cancellation: Cancel the improper transaction and restore the virtual items traded by both parties.

14) Deduction of income from improper transaction: deduction of virtual items obtained by the illegal party or both parties in the illegal transaction.

15) Trading function restrictions: temporarily freeze the virtual items obtained by the offending party or both parties in the improper transaction, and continue to investigate their behavior within the specified period. If it does not violate the regulations again within the specified time limit, it will automatically unfreeze the corresponding virtual items when it expires; if it violates the regulations again within the specified time limit, the frozen virtual items will be deducted when the company determines that the violations exist.

16) Freeze virtual items: limit the relevant functions of virtual items of the role of violating users, including but not limited to the use, transaction, and presenting of items.

17) Recovery of virtual items: recover, including but not limited to, virtual items obtained by users due to fraud or other violations as part of the liquidated damages.

18) Other punishment measures: including but not limited to confiscating undue benefits (such as virtual items obtained by users through improper channels) as part of liquidated damages, value of deductions (including but not limited to experience value, etc.), temporary suspension of services, etc.

5.7 User income and invoicing services

User income refers to the income obtained by users through the order taking and reward services on Oumi. The platform connects the aggregation and deployment of the service side and the demand side to provide relevant technical services for both parties to the transaction. The platform only charges platform service fees for the technical services provided above. The user agrees that Oumi charges the platform service fee for users’ order taking and rewards according to the determined charging standards and rules. The platform service fee is automatically deducted before each settlement, and the user obtains the user income after the deduction from the platform . The user agrees that the user income obtained through the platform is pre-tax income, and the user should pay taxes in accordance with the relevant regulations.

5.8 Special provisions for minors

Special reminder again, if you are a minor, you should read this agreement carefully under the supervision and guidance of your parents or other custodians before clicking to agree to this agreement in the application registration process, otherwise you shall not log in to Oumi and use Oumi service. If you are an adult, but do not meet the provisions of the person with full civil capacity in your area, you are deemed to be a "minor" as specified in this agreement. Special reminder: minor users understand that if you violate laws and regulations or the contents of this agreement, you and your custodian should bear all the consequences caused by this in accordance with the law.

Oumi attaches great importance to the protection of minors ’personal information. Minor users should strengthen their personal protection awareness and be cautious when filling out their personal information, and use Oumi services correctly under the guidance of custodians.

Minor users know and agree that their use of Oumi services should be under the supervision and guidance of their custodians, should learn and use the network correctly within a reasonable range, avoid indulging in virtual network space, and develop good network habits. If custodians and others give mobile phones or other devices to minor users, they should strictly manage the payment passwords of bank cards and other online payment instruments, and do not perform any real-name authentication on behalf of a minor. Oumi operators do not assume any responsibility for any losses caused by regulatory negligence .

Minor users know and agree that Oumi will limit their use of Oumi services to better protect them, The limitations include but not are limited to the restricted use of service content, restricted use of platform charging items, and restrictions on the platform recharge amount, etc. Minors should choose to accept this restriction when using Oumi services, otherwise they have no right to log in to Oumi and use Oumi services.

Users should carefully publish content containing minor materials. Once published, it is deemed that the user agrees Oumi to display minors' information, portraits, sounds, etc., and allows Oumi operator to use and handle such minor-related content.

Unless otherwise agreed or otherwise stated by Oumi operator, all intellectual property rights (including but not limited to copyright, trademark rights, patent rights, trade secrets, etc.) and related rights of all the content (except for the content that the user has copyright), technology, software, programs, data and other information (including but not limited to text, images, pictures, photos, audio, video, graphics, color, layout, electronic documents) on Oumi all belong to Oumi operator or its affiliated company. Without the permission of Oumi operator, no one shall use (including but not limited to copy, disseminate, display, mirror, upload, download, modify, rent) it.

Oumi's Logo, "Oumi", and graphics and combinations thereof, as well as Oumi's other logos, signs, product and service names are trademarks of Oumi or Oumi affiliated companies, and no one shall in any way exhibit, use or dispose of them without the written authorization of Oumi operator, nor shall it be shown to others that you have the right to exhibit, use or dispose of it.

Oumi operators enjoy full intellectual property rights to Oumi proprietary content, original content and other exclusive or exclusive content obtained through authorization. Without the permission of Oumi operator, no unit or individual may privately reprint, disseminate and provide viewing services or other acts that infringe Oumi's intellectual property rights, otherwise they will bear all relevant legal responsibilities including infringement.

7.1 If any third party believes that the user uses Oumi to infringe its civil rights or to commit a tort, the infringed party has the right to notify Oumi operator in writing to take necessary measures such as deletion, masking, and disconnection.

7.2 Any third party that believes that the works, performances, audio and video products involved in Oumi infringes its legal rights and interests may submit a written notice to Oumi operator, requesting Oumi to delete the infringing work, or disconnect the link . The notice shall include the following: the name (name), contact information and address of the right holder; the name and network address of the infringing works, performances, recordings and video products that require deletion or disconnection; the effective right certificate of the right holder material. The right holder shall be responsible for the authenticity of the notice, and if the infringement complaint is untrue, it shall bear corresponding legal responsibility.

7.3 The infringement complaint must include the following information: the infringed person ’s valid proof of rights, or the original link and other certification materials of the infringed work; the specific name and link of the infringing information or work on Oumi; the complainant’s contact information, including e-mail address, phone number or mobile phone, etc. so that Oumi operator can get in touch with you in a timely manner. The content of the complaint must include the following statement: "In the principle of good faith, there is evidence that the object infringes my legitimate rights and interests. I promise that all complaint information is true and accurate, and I will voluntarily bear all consequences. " There shall be a autographic signature and a date. If the complaint is filed on behalf of another person, an authorization letter signed by the authorized person must be presented.

7.4 In order to avoid disputes, the user understands and agrees that all intellectual property rights disputes arising independently from the content of Oumi during the service of Oumi should be resolved separately with Oumi operator.

8.1 Determination of breach of contract

If one of the following situations occurs, it is regarded as your breach of contract:

(1) Violating relevant laws and regulations when using Oumi service;

(2) Violating this agreement or the supplementary agreement of this agreement (i.e., Article 3.2 of this agreement).

In order to adapt to the development of the Internet industry and meet the needs of mass users for efficient and high-quality services, you understand and agree that Oumi operators can set the procedures and standards for determining breach of contract in Oumi rules. For example, Oumi operator can determine whether you constitute a breach of contract based on the relationship between your user data and massive user data.The authenticity of the data shall be subject to the background data of Oumi or the third-party platform data approved by the operator of Oumi, and the right of final interpretation belongs to the operator of Oumi; you are obliged to fully prove and reasonably explain the abnormal phenomena of your data, otherwise it will be deemed as a breach of contract.

8.2 Measures for handling breach of contract

If the content and information you publish on Oumi constitute a breach of contract, Oumi operator can immediately delete the corresponding content and information, mask, etc. according to the corresponding rules or suspend the use of your account, block, freeze or empty the virtual gifts and cancellations. If your behavior on Oumi, or the behavior that has not been implemented on Oumi but has an impact on Oumi and its users, constitutes a breach of contract, Oumi operator may perform restrictions on participation and suspension of your account in accordance with the corresponding rules. 8.3 Liability

If your actions cause losses to Oumi operators and / or their affiliates (including but not limited to their own direct economic losses, goodwill losses and externally paid compensation, settlement, legal fees, litigation fees and other indirect economic losses ), You shall compensate Oumi operators and / or their affiliated companies for all the above losses. If your actions cause Oumi operator and / or its affiliated companies to be subject to rights claimed by a third party, Oumi operator and / or its affiliated companies may recover all losses from you after assuming financial payment obligations to the third party .

8.4 Special agreement

Oumi operators are responsible for providing Oumi services to you "as is" and "available". Oumi operator bears the corresponding obligations in accordance with the law, but is unable to respond to the maintenance of the information network equipment, connection failures, computer, communication or other system failures, hacking activities, computer viruses, power failures, strikes, riots, fires, floods , Storms, explosions, wars, government actions, the orders of judicial administrative agencies or the results of damages caused to you by third parties. And Oumi operator resume no responsibility to this. Oumi operators do not guarantee that the services controlled or provided are appropriate and feasible in all countries or regions. Any user who uses Oumi services in other jurisdictions should ensure that they comply with local laws and regulations. Oumi operators will be assumed no liability.

Oumi operators may modify this agreement and supplementary agreement from time to time according to the changes in national laws and regulations and Oumi services. The changed agreement and supplementary agreement (hereinafter referred to as "changes") will be agreed through the way in Article 10 of this agreement to notify you. Once the updated agreement terms are announced, they will replace the original agreement terms.

If you disagree with the change, you should stop using Oumi service from the effective date of the change; if you continue using Oumi service after the change takes effect, it is deemed that you agree to the effective change.

You agree that Oumi operator will send you notifications, information, and communication or contact requests to you in the following reasonable ways:

(1) The publicized texts, including but not limited to the revised "User Agreement";

(2) Messages on Oumi, pop-up messages, and messages pushed by APP;

(3) E-mails, SMS, phone calls, messages on instant messaging tools, and letters, etc. sent or made according to the contact information you reserved on Oumi;

Oumi operator will send you a notification through the above method, and it will be deemed to be delivered when it is sent successfully; the written notification sent by the paper carrier will be deemed to be delivered on the fifth natural day after it is sent according to the provided contact address.

For any disputes arising from trading activities on Oumi, you agree that the judiciary (including but not limited to courts and arbitration institutions) can serve you legal documents (including but Not limited to litigation documents and arbitration documents). The mobile phone number, e-mail address and other contact information you specify to receive legal documents are the mobile phone number and e-mail contact information you provided when you registered and updated on Oumi. Judicial authorities shall send the legal documents to the above contact information as if they were served. The mailing address you specify is your legal contact address or the valid contact address you provided.

You agree that the judiciary may use one or more of the above delivery methods to deliver legal documents to you. The judiciary may serve you with legal documents in multiple ways, and the delivery time shall be based on the first delivery method among the above delivery methods.

You agree that the above delivery method applies to all stages of the judicial process. Such as entering the proceedings, including but not limited to the first instance, second instance, retrial, execution and supervision procedures.

You should ensure that the contact information provided is accurate, effective, and updated in real time. If the contact information provided is inaccurate or the changed contact information is not notified in time, the legal documents cannot be delivered or not delivered in time, and you shall bear the legal consequences that may arise from it.

11.1 Case of termination

You have the right to terminate this agreement in any of the following ways:

(1) You can cancel your account through the website when meeting the clearing conditions such as account cancellation on the website of Oumi;

(2) Before the change becomes effective, you stop using it and expressly do not want to accept the change;

(3) You expressly do not want to continue using the services of Oumi and meet the termination conditions of Oumi.

When the following conditions occurs, Oumi operator may notify you to suspend or terminate this agreement without taking any responsibility by the methods listed in Article 10 of this agreement:

(1) If you violate this agreement, Oumi operator will terminate this agreement in accordance with the breach clause

(2) If you transfer your account, misappropriate someone else's account, provide false registered identity information, publish prohibited content and information, defraud others' property, or take improper means for profit, Oumi operators have the rights to seal your account in accordance with Oumi rules;

(3) In addition to the above circumstances, because you have repeatedly violated the relevant provisions of Oumi rules and the circumstances are serious, Oumi operator has the rights to seal up your account in accordance with Oumi rules;

(4) Your account was cleared or cancelled by Oumi operator in accordance with this agreement;

(5) You have violated the legal rights or interests of others or other serious violations of laws and contracts on Oumi;

(6) Other situations in which Oumi operator should terminate the service in accordance with relevant laws and regulations.

11.2 Treatment after termination of the agreement

After the termination of this agreement, unless clearly stipulated by law, Oumi operator has no obligation to disclose any information in your account to you or your designated third-party vendors.

After the termination of this agreement, Oumi operators enjoy the following rights:

(1) Stop collecting and using your personal information, but can continue to save other content and information that you keep on Oumi;

(2) For your past breaches, Oumi operator can still hold you accountable for breach of contract in accordance with this agreement.

The conclusion, entry into force, interpretation, amendment, supplementation, termination, execution and dispute resolution of this agreement shall be governed by the laws of Hongkong, China, without regard to the principle of legal selection; if there are no relevant provisions in the law, refer to business practices and / or industry practices.

Disputes arising from using Oumi service and related to Oumi service will be resolved by Oumi operator in consultation with you. When the negotiation fails, either party shall submit to the Wuhan International Arbitration Center, and the arbitration shall be conducted by it in accordance with the Wuhan International Arbitration Center ’s arbitration rules. The place of arbitration shall be Wuhan, and the language of arbitration shall be Chinese.

If any clause of this agreement is deemed to be repealed, invalid or unenforceable, the clause shall be regarded as divisible and shall not affect the validity and enforceability of the remaining clauses of this agreement.

［契約の締結］登録ページの案内に従って情報を入力し、本契約を読み同意したうえで、すべての登録手続を完了した時点で、あなたは本契約の全内容を十分に読み、理解し、受け入れたものとみなされ、Oumi運営者との間で合意が成立し、Oumiの「ユーザー」となります。本契約を読む過程において、本契約またはいずれかの条項に同意しない場合は、直ちに以後の手続を中止し、Oumiサービスの利用を停止してください。「同意」「承諾」「アカウント登録」等のボタンをクリックした場合、または実際にOumiサービスを利用した場合は、本契約を完全に受諾し締結したものとみなされます。登録手続を行っていない場合、または本契約発効前にすでにOumiの登録ユーザーであった場合であっても、Oumiにアクセスし、かつ／またはこれを利用した時点で、本契約の全内容に同意したものとみなされます。これに同意しない限り、Oumiへアクセスまたは利用する権利はありません。

［本契約の変更］本契約締結後、国の政策、製品機能や形態、運営計画、本契約の履行環境等の変化により、本契約の内容が変更される場合があります。改訂後の契約はOumi上に掲載され、いつでも閲覧できます。改訂後の契約に異議がある場合は、直ちにログインおよびOumiサービスの利用を停止してください。ログインまたは引き続きOumiを利用した場合、改訂後の契約を認識し、これに拘束されることに同意したものとみなされます。

［海外ユーザー］中国香港のユーザーでない場合、あなたは所在国または地域の法令にも従う必要があり、本契約の締結および履行が、あなたが所属し、居住し、事業活動その他の活動を行う国または地域の法令に違反しないことを確認するものとします。

Oumi：Oumiのウェブサイトおよびアプリをいいます。

Oumiサービス：Oumi運営者が、Oumiウェブサイトその他の各種形態を通じて、インターネットに基づきあなたに提供する各種サービスをいいます（今後の技術発展により生じる新たなサービス形態を含みます。）。ユーザーがOumi運営者の関連会社の製品またはサービスにログインまたは利用し、それらの関連製品またはサービスに独立したユーザー契約およびプライバシーポリシーが存在しない場合、本契約はそれらの製品またはサービスにも適用されます。

Oumi運営者：Onlyou Co., Limitedおよびその関連当事者をいいます。

Oumiルール：Oumiの各ウェブサイト上ですでに公表され、また今後公表されるすべての規則、解釈、告知その他の内容、ならびにOumiの各チャネルおよびイベントページ上で公表される各種規則、実施細則、製品説明、告知等（「Oumi Agency Violation Management Measures」「Chat Room Management Standards」「Master Management Rules」「User Behavior Rules」「Information Release Standards」等を含みます。）をいいます。後に更新または調整されるOumiルールもOumiルールの不可分の一部を構成することを、あなたは理解し同意します。Oumiルールは十分に公示されており、プラットフォーム上のすべてのユーザーに対して有効かつ拘束力を有します。ユーザー：以下「あなた」または「ユーザー」といい、本契約に基づき登録し、ログインし、利用し、閲覧し、サービスを取得する個人または組織をいいます。

3.1 契約当事者

本契約は、Oumiへの登録、ログインおよびOumiサービスの利用に関して、あなたとOumiとの間で締結される契約です。本契約は、あなたおよびOumi運営者に対して契約上の効力を有します。Oumi運営者とは、Oumiを運営する法的主体を指します。本契約に基づき、Oumi運営者はOumiの事業調整に応じて変更される場合があります。変更後のOumi運営者は、あなたと共同して本契約を履行し、サービスを提供します。新たなOumiサービスの追加に伴い、新たなOumi運営者が追加される場合もあります。あなたが追加されたOumiサービスを利用した場合、追加されたOumi運営者があなたとの間で本契約を履行することに同意したものとみなされます。紛争が生じた場合、あなたは実際に利用したサービスおよびあなたの権利に影響を与えた具体的行為に基づき、紛争の相手方主体を特定することができます。

4.1 ユーザー資格

あなたは、Oumiサービスを利用／登録する前に、所在地域の法律により要求される、自己の行為に適合した民事行為能力を有していなければならないことを確認するものとします。前記の行為能力を有していない場合、その結果生じる一切の結果は、あなたおよびあなたの法定後見人が法に従って負担するものとします。12歳未満の未成年者はOumiユーザーとして登録し、またはOumiサービスを利用することはできません。12歳を超える未成年ユーザーについては、その法定後見人が本契約および改訂内容を読み、理解し、同意した場合に限り、サービスの利用を開始または継続できます。未成年ユーザーが利用を開始または継続した場合、その法定後見人が本契約および改訂内容のすべてを読み、理解し、同意したものとみなされます。

また、あなたは、いずれの国、国際機関または地域による取引制限、制裁または法令上の禁止対象でもないことを確保する必要があります。そうでない場合、正常に登録およびサービス利用ができないことがあります。

4.2 アカウントの説明

登録ページの案内に従って情報を入力し、本契約を読み同意したうえで、すべての登録手続を完了すると、あなたはOumiアカウントを取得し、Oumiユーザーとなることができます。あなたは、自ら設定または確認したOumiユーザー名（以下「アカウント名」といいます。）およびパスワード（総称して以下「アカウント」といいます。）を用いてOumiへログインする権利を有します。Oumiアカウントはあなたの個人情報およびOumiの業務情報に関連付けられているため、当該アカウントはあなた本人のみが利用できます。Oumi運営者の同意なく、第三者に対し、直接または間接に、あなたのOumiアカウントの利用やアカウント内情報の取得を許可してはなりません。アカウントから生じる一切の責任および結果はあなたが負担し、Oumi運営者は責任を負いません。ただし、Oumi運営者があなたのアカウント利用がアカウントの安全性および／またはOumi情報の安全性を危険にさらすと判断した場合、相応のサービス提供を拒否し、または本契約を終了することがあります。ユーザーアカウントは信用情報に関連付けられているため、法的要請、司法判断、またはOumi運営者の同意があり、かつOumiルールに定めるアカウント移転手続に従う場合に限り、移転することができます。アカウントが移転された場合、そのアカウントに基づく権利義務も併せて移転されます。これを除き、アカウントはいかなる方法によっても移転してはならず、これに違反した場合に生じる一切の責任はあなたが負担します。Oumiサービスのより良い利用およびアカウント安全確保のため、Oumi運営者は、Oumiおよび法令の要求に従い、実名認証の完了を求めることがあります。長期間ログインされていないアカウントについて、Oumi運営者は、Oumiデータベース内の当該アカウントに関する記録（登録情報、バーチャルギフト情報等を含みますが、これらに限られません。）を抹消、回収、置換または削除する権利を有し、その場合、当該アカウントはOumiのいずれのプラットフォームにもログインできなくなり、対応するサービスも同時に終了します。Oumiは、そのようなアカウントを整理する前に、ポップアップ、ウェブサイト公告、サイト内メッセージ、ユーザー向けプッシュ通知等を含むがこれらに限られない方法により通知します。

4.3 登録情報の管理

4.3.1 真実性および適法性

Oumiサービスを利用する際、あなたは、Oumiのページ上の指示に従い、必要に応じてOumiがあなたに連絡できるよう、識別情報、連絡先番号等を含むがこれらに限られない情報を正確に提供しなければなりません。あなたは、提供する情報の真実性および有効性を維持する義務を負うことを理解し、同意します。あなたが設定するアカウント名は、アカウント名管理に関する法令およびOumiルールに違反してはなりません。違反した場合、Oumi運営者はアカウント名を停止または抹消し、主管当局へ報告することができます。

あなたは、アカウント名、アバター、プロフィールその他の登録情報に違法または不適切な情報を含めず、関連機関または著名人の名称等を不正に使用しないことを理解し、約束するものとします。アカウント登録の過程において、法令の最低限度、市民の適法な権利利益、公序良俗および情報の真実性を遵守しなければなりません。

Oumi運営者が、Oumi上で登録または使用されているあなたのカスタム名称が他のユーザーと同一であり、識別困難であると判断した場合、Oumi運営者は当該名称の変更を要求する権利を有します。Oumi運営者が求める期限内に変更しない場合、Oumi運営者は識別記号を付加して区別することができ、あなたはこれに無条件で同意するものとします。

あなたは、Oumiが第三者サービスにアクセスすることにより、一部の製品技術機能（埋め込みコード、プラグイン等）を実装していることを理解し認識するものとします。前記第三者サービスは、その職務遂行に必要なユーザー個人情報に限ってアクセスでき、かつ業界先進の技術によりあなたの個人情報の安全を保護することを確保します。あなたは、より良いサービス提供およびアカウント安全確保のため、Oumiプラットフォーム運営者が、あなたの提供する携帯電話番号、身分証番号その他の情報に基づき、通信事業者、金融サービス機関その他の信頼できる機関に対して、ユーザーの本人確認の真実性、信用記録および携帯番号の有効性状況を照会することに同意し、これを許諾します。

4.3.2 更新および維持

あなたは、提供した情報（登録情報等を含みますが、これらに限られません。）を適時更新し、それが適時、詳細、真実かつ正確であることを確保しなければなりません。法令によりOumi運営者がユーザー情報の確認を明確に求められる場合、Oumi運営者は法に従い随時あなたの情報を確認・検証することができ、あなたは最新、真実かつ完全な情報を提供するよう協力しなければなりません。関連情報を変更または削除した場合、システムに保存されたコンテンツ、画像、動画等の喪失を招くことがあります。あなた自身の操作に起因するコンテンツ喪失について、Oumi運営者は責任を負いません。前回提供された情報に基づいてOumi運営者が連絡できなかった場合、またはOumi運営者の要求に従って適時情報を提供しなかった場合、あるいは提供情報が明らかに虚偽である場合、または行政・司法当局により当該情報が無効であると確認された場合、あなた、他者およびOumi運営者に生じた一切の損失および不利益はあなたが負担するものとします。Oumi運営者は、照会通知または是正要求通知を送付し、再認証を求め、またはOumiサービスの一部もしくは全部の提供を停止もしくは終了することができます。Oumi運営者はこれについて責任を負いません。

4.3.3 アカウントセキュリティ規定

あなたのアカウントはあなたのために設定され、あなた自身が保管するものです。Oumiがいかなる時点でもあなたにアカウントパスワードの提供を求めることはありません。したがって、各オンラインセッション終了時には、正しい手順でログアウトしOumiを離れるとともに、アカウントを安全に保管することを推奨します。あなたが自発的にOumi運営者へ通知し、アカウントのログインおよび利用停止措置を求めた場合、Oumi運営者は、登録時の本人確認情報と一致する有効な身元情報の提供および検証を求めることができ、これがない場合は当該請求を拒否する権利を有します。Oumi運営者が、あなたの提供した本人確認情報が登録情報と一致すると確認した場合、適時に当該ユーザーアカウントのログインおよび利用停止措置を講じるものとします。ユーザーが有効な本人確認書類を提供しない場合、または提供した本人確認書類が登録情報と一致しない場合、Oumi運営者は当該請求を拒否する権利を有します。あなたの積極的開示、または他者からの攻撃もしくは詐欺によりアカウントに生じた損失および結果は、あなたが負担するものとし、Oumi運営者は責任を負いません。あなたは司法、行政その他の救済手段を通じて侵害者に対し請求することができます。あなたのアカウントはあなただけが利用でき、所定の手続を経ずに他者に貸与、贈与、賃貸、譲渡、販売または共有してはなりません。アカウントが無断利用された場合、直ちにOumi運営者へ通知しなければならず、そうしない場合、当該無断利用はあなた自身の行為とみなされ、それにより生じる一切の損失および結果はあなたが負担します。Oumi運営者の責めに帰すべき事由がある場合を除き、アカウントに基づくすべての行為結果（オンライン契約の締結、情報の公開、商品・サービスの購入、情報の開示等を含みますが、これらに限られません。）について、あなたが責任を負います。あなたのアカウントを用いたOumiへの無断ログイン、またはアカウントの盗難・紛失を招く可能性のあるその他の状況を発見した場合は、直ちにOumi運営者へ通知することを推奨します。Oumi運営者があなたの請求に対応するには合理的時間を要し、またあなたの請求に基づき講じられた措置によっても、違反による結果の発生または拡大を回避・防止できないことがあることを、あなたは理解するものとします。Oumi運営者の法的過失がある場合を除き、Oumi運営者は一切の責任を負いません。

4.4 個人データの保護

Oumiの「プライバシーポリシー」および「児童プライバシー保護声明」をご参照ください。当社が提供する製品またはサービスの利用を開始した時点で、あなたはOumiの「プライバシーポリシー」および「児童プライバシー保護声明」を十分に理解し、同意したものとみなされます。

5.1.2 Oumi運営者が直接所有または運営する各ユーザー端末（PC、タブレット、携帯電話等を含みますが、これらに限られません。）

5.1.4 Oumiチャットルームサービス：チャットルームの作成および入室、音声・テキストチャットへの参加

5.1.5 Oumiメッセージサービス：プライベートチャット、グループ、フレンド関係等

5.1.6 Oumi招待、報酬およびレッドパケットサービス：招待の開始、報酬の付与、ユーザーへのレッドパケット送信

5.1.7 ミニゲーム、エージェンシーの作成・参加・管理等、Oumiが提供するその他の技術および／またはサービス（以下「その他の技術およびサービス」といいます。）

（以上を総称して「Oumiサービス」といいます。）Oumiサービスは、Oumi上であなた自身のみが利用できるものです。悪意ある解析等によりOumiサービスをOumiから違法に分離したものは、本契約において合意されたOumiサービスには該当しません。当該行為者はそれにより生じるすべての法的結果について責任を負い、Oumi運営者は法に従いその法的責任を追及します。

Oumiウェブサイトが公表する公式方法のみが、Oumiサービスへの登録、ログイン、ダウンロードおよび利用の唯一の適法な方法です。あなたがその他のルートまたは方法で取得したOumiサービス（アカウント、アイテム、ダウンロード等を含みますが、これらに限られません。）はすべて違法取得に該当し、Oumi運営者はその有効性を認めません。発見された場合、Oumi運営者は直ちに削除、凍結、消去、封鎖等の措置を講じる権利を有します。これにより生じる不利益な結果はすべてあなたが負担し、Oumi運営者は関係する個人または組織の法的責任を法に従って追及することができます。Oumi運営者は、ポップアップ、ウェブサイト告知、サイト内メッセージ等を含むがこれらに限られない方法で、Oumiサービス関連ソフトウェアの修正、置換およびアップグレードを通知する権利を有します。あなたがこれらの修正、置換およびアップグレードに同意しない、または受け入れない場合は、Oumiの利用行為を直接拒否、停止または取り消してください。そうでない場合、あなたは当該修正、置換およびアップグレードに同意し受諾したものとみなされ、引き続き本契約に拘束されます。あなたは、Oumiのバーチャルアイテムに、バーチャルギフト、小道具、称号等が含まれることを理解し認識するものとします。これらの所有権はOumi運営者に帰属し、ユーザーは法に従いプラットフォームのルールに基づいてのみ使用・消費することができ、販売または換金は禁止されます。Oumi運営者は、必要に応じてプラットフォームサービス内に付加価値サービスを設定、追加、変更し、付加価値サービストークンを発行する権利を有します。付加価値サービストークンは実際の通貨を用いて取得され、実通貨がトークンへ変換された後は返還できません。付加価値サービストークンは、関連するバーチャルアイテムの利用権購入または関連付加価値サービスの受領にのみ使用でき、実通貨へ換金することはできません。プラットフォームは、ユーザーによる付加価値サービストークンの使用、報酬またはバーチャルギフトの贈与の実際状況に応じて、対応する魅力値を付与する権利を有します。魅力値はプラットフォーム上でのみ消費でき、実通貨へ換金できません。利用期間に特別の定めがない場合、ユーザーは利用権取得後、対応するOumiサービスが終了するまで各種バーチャルアイテムを継続して使用できるものとします。利用期間に特別の定めがある場合、あなたは有効期限まで当該製品を利用できます。利用期間を超えた場合、Oumi運営者は、ユーザーへの追加通知なく、いつでもその利用権を回収する権利を有します（利用期間はいかなる理由でも中断または停止されません。）。ユーザーがバーチャルアイテムの利用権を購入し、またはその他の付加価値サービスを受領した場合において、当該バーチャルアイテムの有効期間または付加価値サービスの有効サービス期間（ユーザーが実際に利用または享受したか否かを問いません。）が満了したとき、または有効利用回数もしくはサービス回数が使い尽くされたとき、Oumi運営者は、当該バーチャルアイテムの利用権を取り消し、または付加価値サービスの提供を停止する措置を講じることができます。特記事項：Oumi運営者は詐欺防止およびマネーロンダリング防止を非常に重視しています。適用可能かつ必要な法的措置を講じることに加え、詐欺により取得された、またはマネーロンダリングに関連すると当社が判断したユーザーアカウント内のすべてのバーチャルアイテムおよび付加価値サービストークンについて、Oumi運営者は恒久的に没収、凍結し、または元のチャージアカウントへ返還する権利を有します。これには、詐欺により取得されたバーチャルアイテムおよび付加価値サービストークン、詐欺取得後に他のユーザーへ贈与または取引されたそれら、ならびに異常取引またはマネーロンダリングに関与したバーチャルアイテムおよび付加価値サービストークンが含まれます。あなたが保有するバーチャルアイテムまたは付加価値サービストークンが詐欺ルートを通じて購入または取得された疑いがある場合（あなた自身が詐欺手段を用いたか否かを問いません。）、またはアカウント、バーチャルアイテムおよび付加価値サービストークンが通常の取引と一致しないことが判明した場合、Oumi運営者は、あなたのアカウントまたはそのアカウント内の対応額のバーチャルアイテムおよび付加価値サービストークンを凍結する権利を有し、あなたには異議申立ての機会が与えられます。詐欺およびマネーロンダリングに関する判断および最終解釈権はOumi運営者に帰属します。ネットワークサービスの特殊性に鑑み、Oumi運営者は、いつでもサービスの一部または全部（有料サービスを含みます。）を変更、中断または終了する権利を有することを、あなたは理解し確認するものとします。Oumi運営者がサービスを変更、中断または終了する場合、適時にユーザーへ通知し、影響を受けたユーザーへ同等の代替サービスを提供するものとします。あなたは、Oumi運営者が以下の権利を有することを理解し認識するものとします。Oumi運営者による以下の権利行使は契約違反とはみなされず、あなたはOumi運営者の関連法的責任を追及せず、これを免責するものとします。あなたの経験値、レベル、フォロー、サブスクリプション、称号、電子チケット、バーチャルライブパフォーマンスルーム、バーチャルアイテム、バーチャルギフトおよび報酬、ダウンロード、ならびにOumiの運営中に生成されOumiネットワークデータベースに保存されるあらゆるデータ情報（アカウントデータ情報、配信期間情報、バーチャルギフト情報、消費情報等の派生物を含みますが、これらに限られません。以下「派生物」といいます。）について、あなたは所有権を有しないことを確認します（Oumiが別途公表する場合を除きます。）。Oumi運営者はOumiルールに従ったその使用をあなたに許諾するのみであり、前記派生物についていかなる補償責任も負いません。Oumi運営者は、実際の状況に応じて回収日を決定する権利を有し、その際、あなたへの追加通知やあなたの同意を要しません。

あなたは、Oumiサービスまたはその派生物を、再販売、交換、担保設定その他の有償取引による違法な営利目的に利用しないこと、およびOumiサービスまたはその派生物を利用して他者の適法な権利利益を侵害しないことに同意し保証します。ネットワーク上の脆弱性、悪意あるソフトウェアその他の違法な手段によって他人のアカウント、バーチャルギフト等を窃取または横領することは禁止されます。

あなたは、付加価値サービストークンおよび魅力値について、出金が禁止されており、Oumiの公式チャネル以外で行われるバーチャルアイテムのチャージおよび取引はいずれも禁止行為であることを理解し同意します。発見された場合、あなたのアカウントは停止され、アカウント残高、バーチャルギフトその他の付加価値サービスは返金されません。Oumiの非公式チャネルを通じてOumiアカウントへチャージし、またはOumiの有料サービス（Oumi内のバーチャルギフト利用権の購入、その他の付加価値サービスの受領その他各種有料項目を含みますが、これらに限られません。）を購入した場合、犯罪者によるあなたのアカウント、銀行カードその他の有価カードの不正利用等を含むがこれらに限られないリスクおよび経済的損失が生じる可能性があります。Oumiは前記のリスクおよび損失について責任を負いません。

プラットフォームがユーザー向けに提供する関係ラベルおよび関連サービスは、娯楽および交流のみを目的とするものであり、ユーザー間の真実の関係を認証するものではなく、またユーザー間にいかなる真実の関係が成立することを奨励、促進または保証するものでもありません。あなたと他のユーザーとの関係、つながりおよび紛争はプラットフォームとは無関係です。あなたと他のユーザーとの違法な合意、または本契約条項に反する合意は、プラットフォームにより承認されません。プラットフォームは、それにより生じた紛争の処理について一切責任を負いません。本契約およびプラットフォームルールに違反する関連行為について、Oumi運営者は処罰措置を講じる権利を有します。

5.2 自動購読サービス

5.2.1 サービスの説明：Oumi運営者は、製品上の必要に応じて、自動購読サービスをユーザーに提供します。自動購読サービスは、サービス条件および運用指示に厳格に従って実施され、プラットフォームサービスの一部を構成します。プラットフォームは、自らの運営戦略に基づき、自動購読サービスの内容および方法を一方的に決定し、調整する権利を有します。

5.2.2 自動購読手続

1. 自動購読サービスを有効化する前に、あなたは真実、正確、適法かつ有効な個人情報に基づいてプラットフォームユーザーとして登録し、プラットフォームアカウントへのログインに成功しなければなりません。そうでない場合、プラットフォームは自動購読を拒否または取り消す権利を有します。第三者アカウントでログインする場合、当該第三者アカウントおよびそれに含まれる情報が真実、正確、適法かつ有効であることを確保しなければなりません。第三者アカウントの問題によりログインできない場合は、第三者へ解決を求めることができ、Oumiプラットフォーム運営者はこれについて責任を負いません。Oumi運営者は、すでに消費された自動購読料金を返金せず、いかなる形式の補償も行いません。

2. あなたが自動購読サービスを選択した場合、Oumiプラットフォームの自動購読サービスおよび関連サービス規則を受け入れたことを意味します。前記の手続、規則または内容のいずれかに同意しない場合、自動購読の操作を行うことはできません。いったん自動購読の操作が完了した場合、あなたはすべての手続、規則および内容について異議がないものとみなされます。

3. あなたは、自動購読サービスが申請されたアカウントに限って利用されること、自動購読サービスはネットワーク商品およびバーチャル商品に属し、支払後にのみ提供されること、料金はあなたが購入したバーチャル商品／サービスの対価であり、前払金、預金、デビットカードその他の用途のものではないこと、ならびに自動購読サービスは有効化後は返金不可かつ譲渡不可であることを理解し同意します。あなたは、プラットフォーム上で自動購読したバーチャル商品／サービスおよび消費記録等を無料で確認することができ、対応するバーチャル商品／サービスの自動購読を解約することもできます。

5.2.3 自動購読のサービス内容および料金

1. プラットフォーム内のバーチャル商品／サービスが多様であることに鑑み、異なるバーチャル商品／サービスの自動購読には異なる価格が設定され、価格はプラットフォームのページ説明に表示され、調整される場合があることを、あなたは理解し同意します。Oumi運営者は、自らの運営戦略に基づき、全部または一部のバーチャル商品／サービスに関する自動購読料金および適用ユーザー端末を調整する権利を有します。当該調整は、プラットフォームが対応するサービスページまたはその他合理的な方法で通知します。

2. 自動購読サービスのサービス期間は、あなたが自動購読サービスの有効化を選択した時点で開始し、あなたがサービスを解約するか、アカウント残高が不足した時点で終了します。購読を解約する必要がある場合は、現在の購読が満了する24時間前までに、アプリストア内で自動購読機能をオフにしてください。

3. 自動購読サービスは有料サービスであり、当該サービスを利用するには対応するサービス料金を支払う必要があります。プラットフォーム運営者は、当該サービスを取得するその他の方法を提供しません。

4. 自動購読サービスを有効化する前に、アカウント名、および自動更新対象となるバーチャル商品／サービスの内容、価格、サービス期間その他の情報を慎重に確認してください。支払い完了後、自動購読サービス料金は譲渡不可かつ返金不可です。

5. 自動購読サービスの課金基準は、プラットフォームがその運営戦略に基づき独自に決定し、関連するバーチャル商品／サービスページに表示します。自動購読サービスの価格が調整された場合は、プラットフォームで公表された時点の有効価格が優先されます。あなたは、継続的な操作（自動購読の確認、支払継続、自動購読サービスの享受等を含みますが、これらに限られません。）を行うことにより、調整後の課金基準を認識し同意したものとみなされることを理解し同意します。

5.3 サービス規範

Oumiアカウントの所有権はOumi運営者に帰属します。登録完了後、あなたはOumiアカウントの利用権を取得しますが、この権利は初回登録者に帰属します。あなたは、Oumiの登録および利用時に取得したアカウントおよびパスワードを適切に保管し、当該アカウントおよびパスワードによりシステムへログイン後に開始される一連の活動について責任を負う義務があります。ネットワークサービスの特殊性に鑑み、Oumiは、当該アカウントおよびパスワードがあなたによって使用されているかどうかを確認せず、データベースに保存されたアカウントおよびパスワードと一致するかどうかのみを確認します。誰であれ入力されたアカウントおよびパスワードがデータベース保存情報と一致する限り、そのアカウントおよびパスワードでOumiにログインできます。ユーザーが当該アカウントの初回登録者でない場合、Oumi運営者はユーザーへの通知およびいかなる法的責任も負うことなく、当該アカウントを凍結し回収する権利を有します。これにより生じる損失（通信中断、ユーザーデータおよびバーチャルアイテムのリセット等を含みますが、これらに限られません。）はあなたが負担します。ユーザーアカウントに基づくすべての活動はあなた自身の行為とみなされ、あなたが全面的に責任を負います。ユーザーアカウントの所有権またはアカウント残高について争いがある場合、Oumi運営者は、不審アカウント、不審資金、異常チャージ、異常取引を発見したとき、または関係当事者からの苦情を受けたときに、不審または争いのあるアカウントおよび残高を一時凍結する権利を有します。紛争当事者は合理的期間内に、アカウントまたは残高の帰属を証明する証拠を提出しなければなりません。Oumi運営者は、各当事者が提出した証拠に基づいて帰属を判断し、不審または争いのあるアカウントおよび資金を合理的に処理します。

反証がない限り、Oumi運営者は、あなたがOumi上にアップロード、公開または送信したコンテンツの著作権者であるものとして取り扱います。あなたがOumiサービスを利用してコンテンツをアップロード、公開または送信することは、当該アップロードコンテンツ（動画、音声等を含み、以下「パフォーマンス」といいます。）に関するすべての知的財産権（著作権、商標権および関連派生権を含みますが、これらに限られません。）について、Oumi運営者に対し、世界的、取消不能かつ恒久的な無償利用権を付与する権利を有し、その付与に同意していることを意味します。本契約期間中および契約終了後においても、Oumi運営者は前記パフォーマンスをあらゆる方法で使用し、対応する利益を享受することができます。Oumi運営者の事前の書面による同意なく、いかなる第三者に対しても、いかなる方法でも当該コンテンツの利用を提供または許諾し、収益を得ることはできません。

あなたがOumiおよび関連会社のその他関連サービスを利用しやすくするため、あなたは、Oumiアカウントの登録およびOumiサービスの利用過程で提供・形成された情報を、Oumi運営者の関連会社その他の関連会社サービス提供者へ引き渡すことをOumi運営者に許諾するものとします。

あなたは、Oumiサービス利用中に、バーチャル商品の付加価値サービスを購入することができます。特段の指示がない限り、あなたはOumiまたはOumiが認可した合法チャネルを通じてバーチャル商品を取得できます。具体的な利用方法および利用期間は、Oumiページに付された説明または同種の公式文書に従うものとします。バーチャル商品は、ユーザー需要、ウェブサイト戦略調整、ユーザー受容性等の要因により、いつでも調整される場合があります。具体的な情報は、その時点のページ説明をご参照ください。バーチャル商品の性質および特徴に基づき、Oumi運営者はバーチャル商品の返金または交換サービスを提供しません。取得したバーチャル商品をすべて消費し、当該バーチャル商品サービスを継続利用しない場合、当該サービスは終了します。

あなたは本契約の条項を遵守し、本サービスを正しく適切に利用しなければならず、Oumiの秩序を乱してはなりません。これには、Oumiの財務秩序を乱す行為（バーチャル財産、バーチャルギフト等の販売等を含みますが、これらに限られません。）が含まれます。Oumi運営者から書面による許可を得た場合を除き、あなたはバーチャル商品を商業分野で利用してはなりません。これには、取引、交換、担保設定、または特定の方法によるバーチャル商品サービスの利用によって不当利益を得る行為が含まれますが、これらに限られません。なお、不合理な手段によるアカウントチャージ（クレジットカードの不正な現金化を含みますが、これに限られません。）の疑いがある場合、Oumi運営者は合理的判断に基づき、あなたのアカウントを一時的または恒久的に閉鎖する権利を有します。同時に、Oumi運営者は、アカウント、ユーザー名、アカウント資金およびバーチャル商品をいつでも回収する権利を留保します。

すべてのユーザーは、適法なチャネルを通じてOumiのバーチャル商品サービスを取得しなければなりません。非公式に公表されたチャネルを通じて取得したすべてのバーチャル商品およびその派生サービスは、Oumiに対して法的効力を有しません。Oumi運営者は、関連するバーチャル商品を一方的に回収し、対応するサービスを終了する権利を有します。重大な場合、Oumi運営者は、Oumiの全部または一部のサービス利用を停止または終了させ、アカウントを閉鎖し、関係情報を法令に従って保存し、関係部門へ報告する権利を有します。

Oumi上であなたが他者と行った民事行為に起因する法的紛争は、当事者が自ら処理または解決するものとし、Oumi運営者は一切の責任を負いません。Oumi運営者は、ユーザーの適法な権利利益の維持を支援するため、警察の捜査に積極的に協力します。

あなたは、Oumiサービスの利用時に、広範なコンテンツおよび情報源に接することを理解するものとします。Oumi運営者は、当該コンテンツおよび情報の正確性、真実性、可用性、安全性、完全性および適法性について責任を負うことはできません。あなたは、誤った、好ましくない、不適切なまたは攻撃的なコンテンツおよび情報、または他人の権利（知的財産権を含みます。）を侵害する匿名もしくは悪評のある情報に接する可能性があることを理解し認識するものとします。これらのリスクはOumi運営者に起因するものではなく、関連責任についてOumi運営者を追及することはできません。あなたは、Oumi公式カスタマーサービスへ速やかに苦情申立てを行うことによりOumiへ通知することができます。Oumi運営者は、法に従い前記コンテンツの送信を停止し、あなたによるOumiサービスの一部または全部の継続利用を停止し、関連記録を保存し、関係当局へ報告する等の対応措置を講じる権利を有します。

Oumiプラットフォームは、Oumiプラットフォーム上にアップロード、公開または送信されたいかなるコンテンツまたは情報についても、支持、推奨または意見表明を行うものではなく、またそれらに関するいかなる誤り、欠陥、損失または損害についても責任を負いません。コンテンツおよび情報の利用はすべて、あなた自身の責任において行うものとします。

あなたは、Oumi運営者がサービス提供の過程において、さまざまな方法で商業広告またはその他の商業情報を掲載すること（Oumi上のあらゆる位置への広告掲載、およびあなたがアップロードし配信するコンテンツ内への広告掲載を含みますが、これらに限られません。）に同意し、電子メール、サイト内メッセージ、SMS、電話、インスタントメッセージツール、ウェブサイト公告その他の方法により、販促その他関連する商業情報を送信することに同意します。同時に、Oumi運営者は、ライブ配信ルームにウェブサイトロゴ（または名称）および時間のウォーターマークを追加する権利を有します。Oumi運営者は最善を尽くしますが、これがあなたのプラットフォーム体験に影響しないことを保証するものではありません。

あなたは、Oumi上での自身のユーザー行為を自ら制限し、オンラインライブ配信、同行プレイおよびパフォーマンス中の自身の身体的安全および財産安全を確保しなければなりません。あなた自身の理由、不可抗力、突発事件または第三者により生じた人身損害および財産損失について、Oumi運営者は責任を負いません。

Oumiサービスの利用中、あなたは中国香港およびあなたの所在地域におけるコンピュータおよびインターネットに関する法令を遵守しなければなりません。いかなる場合でも、Oumi運営者が合理的にあなたの行為が前記法令に違反する可能性があると判断した場合、事前通知なくいつでもあなたへのサービス提供を終了することができます。

あなたは、Oumiのダウンロード、関連バーチャルアイテムの利用権購入、または関連サービスの受領を選択した時点で、ユーザーが対応する課金方法および価格を十分に理解し受け入れたことを示すことに同意し認識します。ユーザーは、Oumiサービスの課金方法および価格を決定する権利がOumi運営者にあることに同意します。Oumi運営者は、異なる段階におけるOumiの各種サービスについて異なる課金方法および価格を定める権利を有し、必要に応じて価格方針を調整する権利も有します。あなたは、オンラインまたはオフラインの取引において、いかなる形式であれOumiの課金方法および価格を回避しないこと、また私的取引ルートを通じてOumiの課金方法および価格を回避しないことに同意します。

5.4 禁止コンテンツ

あなたは、Oumi上で作成、アップロード、公開または送信するコンテンツ（アカウント名、コメント、弾幕その他の情報を含みます。）に、以下の内容を含めないことを理解し保証します。

(1) 国家機密の漏えい、国家安全の危害、国防の危害、または国家の名誉および利益の侵害

(2) 人種差別、テロ、年齢差別または性差別を助長する内容を含む、憎悪的な発言または行為

(3) 政府に対する憎悪や軽蔑を煽り、政府への不満を喚起する内容

(4) ポルノ、わいせつまたは不適切な内容、またはあらゆる形態の児童搾取を含む成人向けコンテンツ

(5) 死亡または重大な傷害に関する内容を含む、過度に暴力的な内容

(6) 社会秩序を乱し、社会の安定を破壊し、法執行に対する公衆の信頼を揺るがす疑いのある内容

(7) 自殺または自傷行為を描写し、助長し、または支援する内容

(8) 噂、虚偽または誤解を招く情報

(9) 冒涜的、不敬的、または特定の信仰を持つ人々を不快にさせる可能性のある内容、その他宗教に関連する内容

(10) 賭博、中絶、武器、またはその他高度に爆発性のある主題に関連する内容

(11) 他者または集団に対する虐待、中傷、またはその他の嫌がらせ

(12) 他者の適法な権利利益を侵害する内容

(13) スパム、迷惑メール、またはその他の未承諾広告

(14) 関連法令、行政法規および国家規定により禁止されるその他の内容

(15) Oumiが否定的内容または公表・送信に不適切なその他の内容であると判断するもの

あなたがアップロード、投稿または送信したコンテンツに、上記法令に違反する情報または内容、あるいは第三者の適法な権利を侵害する内容が含まれる場合、そのことにより生じる一切の不利益な結果は、あなたが直接負担するものとします。これによりOumiに不利益が生じた場合、あなたは影響除去および、財産損害賠償、信用毀損賠償、弁護士費用、交通費、権利保護のために生じたその他の合理的費用を含むがこれらに限られない一切の損失をOumi運営者へ賠償する責任を負います。

5.5 禁止行為

あなたは、Oumi上で以下の禁止行為を行わず、また他人にあなたのアカウントを使用させて以下の行為を行わせないことを理解し保証します。

1) 他人または組織になりすますこと、または特定の人物・主体と関係があるかのように偽ること（虚偽のアカウント名の設定や他ユーザーのアカウントへのアクセスを含みます。）、または登録アカウントを悪意をもって使用して、アカウント登録時またはOumiサービス利用時（情報のアップロード、公開、配信等を含みますが、これらに限られません。）に他ユーザーを誤認させること

2) タイトルを偽造し、またはその他の方法で内容を操作して、当該内容がOumiから送信されたものであると他人に誤認させること

3) 送信権限のない内容（内部情報、機密情報、他人の特許、商標、著作権、営業秘密その他専有権を侵害する内容等）をアップロード、投稿、メール送信またはその他の方法で送信すること

4) 未承諾または無許可の「スパム」、広告資料、販促資料またはその他の商業的通信をアップロード、投稿、電子メール送信またはその他の方法で送信すること

5) Oumi運営者の明示的な許可なく、Oumiサービスを商業目的または第三者の利益のために利用すること

6) 他人を追跡し、またはその他の方法で嫌がらせを行うこと

7) Oumiが違法または違法となる可能性が高いと判断する活動または取引に参加すること（犯罪手法の教授、違法薬物の販売、マネーロンダリング、詐欺等を含みます。）

8) 賭博、偽装賭博、賭博情報の提供、または何らかの方法で他人を賭博に誘引すること

9) Oumi運営者の知的財産権（Oumiの商標、ブランド、ロゴ、その他の専有資料、ウェブページのレイアウトやデザインを含みます。）を使用すること、またはその他の方法でOumi運営者の知的財産権を侵害すること（Oumiプラットフォームのユーザーまたは使用ソフトウェアのリバースエンジニアリングの試みを含みます。）

10) 自動化プログラム、ソフトウェア、エンジン、ウェブクローラ、ウェブ解析ツール、データ抽出ツールまたは類似ツールを使用してOumiサービスへアクセスし、Oumiサービスを通じて提供されるコンテンツを収集または処理すること

11) Oumiサービスの外観および機能を模倣することを目的として、「フレーム」「ミラー」その他の技術に参加すること

12) いずれかのユーザーまたはその他当事者によるOumiサービスへのアクセスを妨害し、または妨害を試みること

13) ウイルス、ネットワークワーム、トロイの木馬、またはコンピュータソフトウェア、ハードウェア、通信機器の機能、Oumiサービス、Oumiサービスに接続されたサーバーやネットワーク、データやファイルを妨害、破壊または制限する悪意あるコードやプログラムを、故意に拡散すること

14) 他人の明示的同意なく、その者を識別可能な個人情報を共有または公開すること

15) Oumiサービス、システムまたは他ユーザーのシステムに侵入攻撃の脆弱性があるか探索または試験すること、またはOumiサービス、システムまたは他ユーザーのシステムのセキュリティ機能を回避し、または回避を試みること

16) Oumiサービスに使用されるソフトウェアを逆コンパイル、逆アセンブル、リバースエンジニアリングし、またはこれらを試みること

17) 破壊または濫用を目的として複数のアカウントを開設すること、または重複した無効な大量データ・情報を悪意をもってアップロードすること；18) 能動的または受動的なスコア操作、共謀による不正、プラグインその他不正ソフトウェアの使用、ならびにバグ（「脆弱性」または「欠陥」とも呼ばれます。）を利用した違法・不当利益の取得、またはインターネットその他の方法でプラグイン、不正ソフトウェアおよびバグを公開すること等、Oumiサービスの公平性を損ない、またはアプリケーションの正常な秩序に影響を与える行為を行うこと

19) 広告掲載や商品の販売等の商業活動を行うこと、またはOumiのバーチャル商品、プラグイン等の販売など、Oumiの利益を侵害する違法行為を行うこと

20) あなたのOumiアカウントが停止または抹消されたか否かにかかわらず、Oumiまたはその運営者を悪意をもって中傷・名誉毀損し、Oumiまたはその運営者の信用を害する発言または報道を拡散し、ファン、ネットユーザーその他オンライン集団を扇動して悪意ある攻撃を行わせること

21) Oumi運営者の書面による同意なく、あなたのOumiアカウントが停止または抹消されたか否かにかかわらず、ニュースメディア、セルフメディアその他のプラットフォームにおいてOumiまたはその運営者に関するコメントを公表し、またはOumiまたはその運営者に関するインタビューに応じること

22) 中国香港およびあなたの所在地域における関連法令、規則その他法的効力を有する規定に故意または過失により違反すること

5.6 違反の結果

あなたが本契約の規定に違反した場合、他の条項に基づく処罰に加え、Oumi運営者が決定する以下の処分のうち一つまたは複数を負担することにも同意するものとします。

1) 警告：警告は、プラットフォーム規則に違反したユーザーに対する教育的指導にすぎず、プラットフォームの正常な運営を管理するための方法です。

2) 発言禁止：違反ユーザーの一部または全部のチャットチャネルを閉鎖し、ユーザーアカウントのオンライン会話機能を強制停止し、処分が満了または解除されるまで他ユーザーとの会話を禁止します。

3) プレイ権限の一時凍結：違反ユーザーのサービス権限を制限し、一部のプラットフォームサービス操作を、処分が満了または解除されるまで制限します。

4) プレイ権限の永久凍結：違反ユーザーのサービス権限を制限し、一部のプラットフォームサービス操作を制限し、永久に解除しません。

5) 一時的ログイン禁止：違反ユーザーのアカウントは、一定期間、Oumiが提供する一つまたは複数のプラットフォームへログインして利用することができなくなり、処分満了または解除まで継続します。

6) 永久ログイン禁止：違反ユーザーのアカウントは、Oumiサービスへ恒久的にログインできなくなります。

7) 強制オフライン：違法ユーザーに現在のサービスから離脱させ、ユーザーによる現在のサービスの実行を終了させます。

8) アカウント停止：違反ユーザーアカウントのOumiサービスへのログイン権利を停止し、または恒久的に終了させます。

9) 法的責任の追及：ユーザーの不適切行為が他者またはOumiに損害を与え、または現行法に違反した場合、違反ユーザーは法に従い対応する民事、行政または刑事責任を負います。

10) 組織の解散：ユーザーが設立したエージェンシーその他の組織を含むがこれらに限られない組織を解散します。

11) ニックネーム変更：ユーザーが独自に命名できるキャラクター名、ギルド名、チャットルーム名、グループ名等を強制的に変更します。

12) プラットフォーム内サービスの一時制限：違反ユーザーアカウントについて、一定期間、一部サービスの利用を制限します。

13) 取引取消：不適切な取引を取り消し、双方が取引したバーチャルアイテムを原状回復します。

14) 不当取引収益の控除：違法当事者または違法取引の双方が取得したバーチャルアイテムを控除します。

15) 取引機能制限：不適切な取引により取得した違反当事者または双方のバーチャルアイテムを一時凍結し、指定期間内にその行為を継続調査します。指定期間内に再度規定違反がない場合、期間満了時に対応するバーチャルアイテムは自動的に解除されます。指定期間内に再度違反があった場合、会社が違反の存在を確認した時点で、凍結中のバーチャルアイテムを控除します。

16) バーチャルアイテム凍結：違反ユーザーの役割に属するバーチャルアイテムの関連機能（使用、取引、贈与等を含みますが、これらに限られません。）を制限します。

17) バーチャルアイテムの回収：違約金の一部として、詐欺その他の違反によりユーザーが取得したバーチャルアイテム等を回収します。

18) その他の処分措置：不当チャネルにより取得したバーチャルアイテム等の不当利得の没収、価値控除（経験値等を含みますが、これらに限られません。）、サービスの一時停止等を含みますが、これらに限られません。

5.7 ユーザー収益および請求書サービス

ユーザー収益とは、Oumi上の受注および報酬サービスを通じてユーザーが得る収入を指します。プラットフォームは、サービス提供側と需要側の集約および配置を結び付け、取引当事者双方へ関連する技術サービスを提供します。プラットフォームは、前記技術サービスについてのみプラットフォームサービス料を徴収します。ユーザーは、Oumiが定められた課金基準および規則に従い、ユーザーの受注および報酬についてプラットフォームサービス料を徴収することに同意します。プラットフォームサービス料は各決済前に自動控除され、ユーザーは控除後のユーザー収益を取得します。ユーザーは、プラットフォームを通じて取得したユーザー収益が税引前収入であり、関連規定に従って納税しなければならないことに同意します。

5.8 未成年者に関する特別規定

改めて特に注意喚起します。あなたが未成年者である場合、アプリ登録過程で本契約への同意をクリックする前に、必ず父母その他の保護者の監督および指導の下で本契約を慎重にお読みください。そうでない場合、Oumiへログインし、Oumiサービスを利用してはなりません。あなたが成人であっても、所在地域において完全な民事能力者の要件を満たさない場合、本契約上は「未成年者」とみなされます。特に、未成年ユーザーは、法令または本契約内容に違反した場合、その結果生じる一切の結果を、あなたおよび保護者が法に従って負担することを理解するものとします。

Oumiは未成年者の個人情報保護を非常に重視しています。未成年ユーザーは、自己保護意識を高め、個人情報を記入する際には慎重に行い、保護者の指導の下でOumiサービスを正しく利用しなければなりません。

未成年ユーザーは、Oumiサービスの利用が保護者の監督および指導の下で行われるべきであり、合理的な範囲でインターネットを正しく学習・利用し、仮想ネットワーク空間への依存を避け、良好なネットワーク利用習慣を養うべきであることを理解し同意します。保護者その他の者が未成年ユーザーへ携帯電話その他の端末を渡す場合は、銀行カードその他オンライン決済手段の支払パスワードを厳格に管理し、未成年者に代わって実名認証を行ってはなりません。監督不十分により生じた損失について、Oumi運営者は責任を負いません。

未成年ユーザーは、Oumiがより良く保護するために、Oumiサービスの利用を制限することを理解し同意します。これには、サービス内容の利用制限、プラットフォーム有料項目の利用制限、プラットフォームチャージ金額の制限等が含まれますが、これらに限られません。未成年者はOumiサービス利用時に当該制限を受け入れることを選択しなければならず、そうでない場合はOumiへログインし、Oumiサービスを利用する権利を有しません。

ユーザーは、未成年者に関する素材を含むコンテンツを慎重に公開しなければなりません。いったん公開した場合、ユーザーは、未成年者の情報、肖像、音声等をOumiが表示すること、ならびにOumi運営者が当該未成年者関連コンテンツを利用および処理することに同意したものとみなされます。

別段の合意またはOumi運営者による別段の表示がない限り、Oumi上のすべてのコンテンツ（ユーザーが著作権を有するコンテンツを除きます。）、技術、ソフトウェア、プログラム、データその他の情報（文字、画像、写真、音声、動画、図形、色彩、レイアウト、電子文書等を含みますが、これらに限られません。）に関するすべての知的財産権（著作権、商標権、特許権、営業秘密等を含みますが、これらに限られません。）および関連権利は、すべてOumi運営者またはその関連会社に帰属します。Oumi運営者の許可なく、何人もこれらを利用（複製、配布、表示、ミラーリング、アップロード、ダウンロード、変更、賃貸等を含みますが、これらに限られません。）してはなりません。

Oumiのロゴ、「Oumi」、その図形および結合表示、ならびにOumiのその他ロゴ、標章、製品名およびサービス名は、OumiまたはOumi関連会社の商標です。Oumi運営者の書面による許諾なく、何人もいかなる方法でもこれらを表示、使用または処分してはならず、また自身がそれらを表示、使用または処分する権利を有するかのように他者へ示してはなりません。

Oumi運営者は、Oumi独自コンテンツ、オリジナルコンテンツおよび許諾により取得したその他の独占的または専有的コンテンツについて、完全な知的財産権を有します。Oumi運営者の許可なく、いかなる組織または個人も、私的に転載、配布、視聴サービス提供その他Oumiの知的財産権を侵害する行為をしてはならず、違反した場合には侵害責任を含む一切の関連法的責任を負います。

7.1 第三者が、ユーザーがOumiを利用してその民事権利を侵害し、または不法行為を行ったと考える場合、権利を侵害された当事者は、Oumi運営者に対して書面により通知し、削除、マスキング、切断等の必要な措置を講じるよう求める権利を有します。

7.2 Oumiに関わる作品、実演、音声・映像製品が自己の適法な権利利益を侵害していると考える第三者は、Oumi運営者に対して書面通知を提出し、侵害作品の削除またはリンクの切断を求めることができます。通知には、権利者の氏名（名称）、連絡先および住所、削除または切断を求める侵害作品、実演、録音・映像製品の名称およびネットワークアドレス、ならびに権利者の有効な権利証明資料を含めなければなりません。権利者は通知の真実性について責任を負い、侵害苦情が真実でない場合、相応の法的責任を負うものとします。

7.3 権利侵害に関する苦情には、以下の情報を含めなければなりません。すなわち、被侵害者の有効な権利証明、または被侵害作品の原リンクその他の証明資料、Oumi上に存在する侵害情報または作品の具体的名称およびリンク、ならびにOumi運営者が適時に連絡できるよう、苦情申立人の連絡先（電子メールアドレス、電話番号または携帯番号等）です。苦情内容には、必ず次の声明を含めなければなりません。「誠実信用の原則に基づき、当該対象が私の適法な権利利益を侵害していることを示す証拠があります。私は、すべての苦情情報が真実かつ正確であることを保証し、そのすべての結果を自発的に負担します。」さらに、自署および日付が必要です。他人を代理して苦情を提出する場合は、委任者が署名した委任状を提示しなければなりません。

7.4 紛争を回避するため、ユーザーは、Oumiのサービス期間中にOumiコンテンツから独立して生じたすべての知的財産権紛争について、Oumi運営者と別途解決すべきことを理解し同意します。

8.1 違約の認定

次のいずれかの状況が生じた場合、あなたの違約とみなされます。

(1) Oumiサービスの利用に際して関連法令に違反した場合

(2) 本契約または本契約の補充契約（すなわち本契約第3.2条）に違反した場合

インターネット業界の発展に適応し、多数ユーザーによる効率的かつ高品質なサービスの需要を満たすため、Oumi運営者はOumiルールにおいて違約認定の手続および基準を定めることができることを、あなたは理解し同意します。例えば、Oumi運営者は、あなたのユーザーデータと大量のユーザーデータとの関係に基づいて、あなたが違約を構成するか否かを判断することができます。データの真実性はOumiのバックエンドデータまたはOumi運営者が承認した第三者プラットフォームデータを基準とし、最終解釈権はOumi運営者に帰属します。あなたは、自身のデータ上の異常現象について十分な証明と合理的説明を行う義務を負い、これを行わない場合、違約とみなされます。

8.2 違約に対する取扱措置

あなたがOumi上で公開したコンテンツまたは情報が違約を構成する場合、Oumi運営者は、対応するルールに従って直ちに当該コンテンツ・情報を削除し、マスキングし、またはあなたのアカウントの使用を停止し、バーチャルギフトの封鎖、凍結もしくは消去等を行うことができます。あなたのOumi上での行為、またはOumi上で実施されていないがOumiおよびそのユーザーへ影響を与える行為が違約を構成する場合、Oumi運営者は、対応するルールに基づき、参加制限やアカウント停止等の措置を講じ、バーチャルパフォーマンスルームの封鎖、バーチャルギフトの凍結または消去、違約金控除等を含む一部または全部のサービス提供措置をとることができます。あなたの行為が重大な違約を構成する場合、Oumi運営者は、あなたのアカウントを閉鎖し、あなたへのサービス提供を終了することができます。アカウントが閉鎖された場合、アカウント内のバーチャル商品は消去され、関連するバーチャル商品サービスも終了します。

あなたのOumi上での行為が関連法令に違反する場合、Oumi運営者は法に従い、あなたの利用記録その他情報を関係当局へ報告および提出することができます。同時に、Oumi運営者は、行政または司法当局の有効な法的文書によって確認された前記違反行為に対する取扱措置およびその他違法情報をOumi上に公表することができます。さらに、Oumi運営者は、関連法令に従い、あなたについてブラックリスト管理および信用管理を行い、信用評価と連動した管理およびサービスを提供することができます。あなたがブラックリストに掲載された場合、Oumiは、当該アカウントの再登録を禁止する措置を講じ、適時に関係当局へ報告する権利を有します。

8.3 責任

あなたの行為によりOumi運営者および／またはその関連会社に損失（自己の直接的経済損失、営業上の信用損失、対外的に支払った賠償金、和解金、弁護士費用、訴訟費用その他の間接的経済損失を含みますが、これらに限られません。）が生じた場合、あなたは前記すべての損失についてOumi運営者および／またはその関連会社に賠償しなければなりません。あなたの行為によりOumi運営者および／またはその関連会社が第三者から権利主張を受けた場合、Oumi運営者および／またはその関連会社は、当該第三者に対して金銭支払義務を負った後、そのすべての損失をあなたへ求償することができます。

8.4 特別合意

Oumi運営者は、「現状有姿」かつ「提供可能な範囲」でOumiサービスを提供します。Oumi運営者は法に従って相応の義務を負いますが、情報ネットワーク設備の保守、接続障害、コンピュータ、通信その他システムの障害、ハッキング行為、コンピュータウイルス、停電、ストライキ、暴動、火災、洪水、嵐、爆発、戦争、政府行為、司法行政機関の命令または第三者によりあなたに生じた損害の結果については対応できず、これらについて責任を負いません。Oumi運営者は、管理または提供するサービスがすべての国または地域において適切かつ利用可能であることを保証しません。他の法域でOumiサービスを利用するユーザーは、現地法令を遵守していることを自ら確保しなければならず、Oumi運営者は一切責任を負いません。

Oumi運営者は、国の法令およびOumiサービスの変化に応じて、本契約および補充契約を随時変更することができます。変更後の本契約および補充契約（以下「変更」といいます。）は、本契約第10条に定める方法によりあなたへ通知されます。更新後の契約条項が公表された時点で、元の契約条項に優先して適用されます。

あなたが変更に同意しない場合、変更の発効日からOumiサービスの利用を停止しなければなりません。変更発効後もOumiサービスを継続利用した場合、当該変更に同意したものとみなされます。

あなたは、Oumi運営者が以下の合理的な方法により、通知、情報、連絡または接触要求をあなたへ送付することに同意します。

(1) 改訂後の「ユーザー契約」を含むがこれに限られない、公表された文書

(2) Oumi上のメッセージ、ポップアップメッセージ、およびアプリによるプッシュメッセージ

(3) Oumiに登録された連絡先情報に基づいて送信または実施される電子メール、SMS、電話、インスタントメッセージツール上のメッセージおよび書面等

Oumi運営者が前記方法によりあなたへ通知を送付した場合、送信に成功した時点で送達済みとみなされます。紙媒体による書面通知は、提供された連絡先住所宛に発送された日から5日目の自然日に送達されたものとみなされます。

Oumi上の取引活動から生じる紛争について、あなたは、司法機関（裁判所および仲裁機関を含みますが、これらに限られません。）が、訴訟文書および仲裁文書を含むがこれらに限られない法的文書をあなたに送達できることに同意します。あなたが法的文書の受領先として指定した携帯電話番号、電子メールアドレスその他の連絡先は、あなたがOumiへの登録時および更新時に提供した携帯電話番号および電子メール連絡先とします。司法機関が前記連絡先へ法的文書を送付した場合、送達済みとみなされます。あなたが指定した郵送先住所は、あなたの法的連絡先住所またはあなたが提供した有効な連絡先住所とします。

あなたは、司法機関が上記送達方法の一つまたは複数を用いてあなたへ法的文書を送達できることに同意します。司法機関は複数の方法で法的文書を送達することができ、その送達時期は前記送達方法のうち最初に行われた送達方法を基準とします。

あなたは、上記送達方法が、第一審、第二審、再審、執行および監督手続を含むがこれらに限られない、司法手続のすべての段階に適用されることに同意します。

あなたは、提供する連絡先情報が正確かつ有効であり、リアルタイムに更新されることを確保しなければなりません。提供された連絡先情報が不正確である場合、または変更後の連絡先情報を適時に通知しなかった場合、法的文書が送達できない、または適時に送達できないことにより生じうる法的結果は、あなたが負担するものとします。

11.1 終了事由

あなたは、次のいずれかの方法により本契約を終了する権利を有します。

(1) Oumiウェブサイトにおけるアカウント抹消等の清算条件を満たした場合、ウェブサイトを通じてアカウントを抹消することができます。

(2) 変更が効力を生じる前に利用を停止し、当該変更を受け入れない意思を明示した場合

(3) Oumiサービスの継続利用を明示的に望まず、かつOumi所定の終了条件を満たした場合

次の各号のいずれかに該当する場合、Oumi運営者は、本契約第10条に定める方法により通知したうえで、いかなる責任も負うことなく、本契約を停止または終了することができます。

(1) あなたが本契約に違反し、Oumi運営者が違約条項に基づいて本契約を終了する場合

(2) あなたがアカウントを譲渡し、他人のアカウントを横領し、虚偽の登録本人情報を提供し、禁止コンテンツや情報を公開し、他人の財産を詐取し、または不当な手段で利益を得た場合、Oumi運営者はOumiルールに従ってあなたのアカウントを封鎖する権利を有します。

(3) 上記のほか、あなたがOumiルールの関連規定に繰り返し違反し、その事情が重大であるため、Oumi運営者がOumiルールに従ってあなたのアカウントを封鎖する権利を有する場合

(4) あなたのアカウントが本契約に従ってOumi運営者により消去または抹消された場合

(5) あなたがOumi上で他者の適法な権利利益を侵害した場合、またはその他の重大な法令・契約違反を行った場合

(6) その他、関連法令に従ってOumi運営者がサービスを終了すべき場合

11.2 契約終了後の取扱い

本契約の終了後、法令に明確な定めがある場合を除き、Oumi運営者は、あなたまたはあなたが指定する第三者ベンダーに対し、あなたのアカウント内のいかなる情報も開示する義務を負いません。

本契約終了後、Oumi運営者は次の権利を有します。

(1) あなたの個人情報の収集および利用を停止する一方、Oumi上に残されているその他のコンテンツおよび情報は引き続き保存できること

(2) あなたの過去の違約について、Oumi運営者が引き続き本契約に基づく違約責任を追及できること

本契約の締結、発効、解釈、変更、補充、終了、履行および紛争解決には、法選択の原則を考慮することなく、中国香港の法律が適用されます。法令に関連規定がない場合は、商慣行および／または業界慣行を参照します。

Oumiサービスの利用から生じ、Oumiサービスに関連する紛争は、Oumi運営者とあなたとの協議により解決するものとします。協議が不調に終わった場合、いずれの当事者も武漢国際仲裁センターへ付託し、同センターの仲裁規則に従って仲裁を行うものとします。仲裁地は武漢とし、仲裁言語は中国語とします。

本契約のいずれかの条項が廃止、無効または執行不能と判断された場合でも、当該条項は分離可能なものとみなされ、本契約の残りの条項の有効性および執行可能性には影響しません。
